GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2019 GMC Sierra revealed with CarbonPro bed and new diesel engine

It's only March, and it's already been one hell of a year for trucks. January's Detroit Auto Show saw the reveals of the 2019 Ram 1500, 2019 Ford Ranger and the 2019 Chevy Silverado. The Chicago Auto Show brought new versions of the Toyota Tacoma and Toyota Tundra TRD Pro. Today, we finally got our first look at the Silverado's twin, the 2019 GMC Sierra. The truck features new styling, a new diesel engine and — on the Sierra Denali — a carbon fiber bed. As with every new full-size truck, the Sierra is larger than the outgoing model in almost every dimension, though exact dimensions haven't been revealed. For reference, though, the Chevy Silverado's bed is 7-inches wider than before. The new Sierra grille is more upright than before and features new C-shaped lighting. The Denali gets LED headlights, tail lights and fog lights. Both SLT and Denali trims get unique 22-inch wheels. As we saw in spy photos, the Sierra's interior is mostly just a copy of the Silverado's with some chrome accents sprinkled throughout. If you like the current truck interiors, you'll be pleased with the new model. Those hoping for a wholesale change will be left wanting. The big improvements inside include a full-color heads-up display, trailer hitch assist apps and cameras, and the rear-camera mirror found in models like the Chevy Traverse and Cadillac CT6. Safety and convenience features include a surround-view camera, blind-spot monitoring, pedestrian detection and low-speed automatic braking. Like the Silverado, there's been a significant effort to cut weight in the new Sierra. The 2019 model loses as much as 360 pounds compared to the current truck. It uses aluminum for the doors, hood and tailgate. Steel is still used for the fenders, roof and standard cargo box. The Denali, however, gets the real surprise here. Available only on the top-tier trim, the bed box will be constructed of carbon fiber rather than steel, saving 62 pounds. Carbon fiber only replaces the steel inner panels and floor. GMC says the carbon fiber will also help scratch and corrosion resistance. SLT and Denali models also get a new MultiPro tailgate. This is unique to the Sierra and separate from the Silverado's power assist unit. A new feature that helps one get into and out of the bed using an assist handle. The tailgate step has a maximum weight capacity of 375 pounds. There multiple positions that allow customers to extend the bed, or drop the center vertically to gain easier access to the back.

GM to idle car production at five factories as Americans continue CUV love affair

In case you needed another reminder that Americans have fallen out of love with sedans, General Motors today announced plans to idle five factories in January in a bid to cut its inventory to 70 days. Detroit-Hamtramck Assembly ( Buick LaCrosse, Cadillac CT6, Chevrolet Volt and Impala) and Fairfax Assembly in Kansas ( Chevy Malibu) will stop production for three weeks. Lansing Grand River ( Cadillac ATS and CTS, and Chevy Camaro) is going down for two weeks, while Lordstown, OH ( Chevy Cruze) and Bowling Green, KY ( Chevy Corvette) will go idle for a week each, Automotive News reports. GM's shutdown reflects a broader problem with the company's supply – at 847,000 vehicles, the company's supply increased unsteadily from a low of 629,000 units in January of 2016. That's more than a 25 percent increase in the past year. Citing information from Autodata, The Detroit News reports that at the end of November, GM had a 168-day supply of LaCrosses, 177 days' worth of Camaro, 170 days of Corvette, 121 days for Cruze, 119 days for ATS, 132 days for CTS, and 110 days of CT6. Meanwhile, inventory of the company's more popular vehicles is actually below the professionally accepted 60- to 70-day supply, The News reports. The Trax, Colorado pickup, and GM's full-size SUVs are sitting below 50 days and experiencing year-over-year sales increases. GM needs a rethink of its inventory levels, which is something that's apparently coming. "We're going to be responsible in managing our inventory levels," GM spokesman Jim Cain told The News. Another unnamed spokesman told Automotive News the company's day-to-day supplies would "fluctuate before moderating at year-end." But at least one analyst thinks this won't be the last time Detroit needs to stop production to level things out. "Incentives are elevated, residuals are declining, and rates are rising," Brian Johnson, an analyst with Barclays, told The News. "And while GM in particular may benefit in the months ahead from new product launches, it's important to recognize that GM's inventory is elevated at the moment, and it wouldn't surprise us if they need to announce another production cut – which could pressure the stock."
