Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

A new study predicts that biofuels capacity will grow to 61 billion gallons per year by 2018. The findings from Lux Research also suggest that biodiesel and ethanol will make up 96 percent (about 5.76 billion gallons) of that. Sixty-four percent of biofuels will come from the Americas, led by the US and Brazil, but with Colombia and Argentina emerging as important producers. Other large emerging producers are China, Indonesia, and Thailand in Asia, and Portugal, Poland, and France in Europe. A large share of next-generation biofuels are expected to come from waste oils. The images show what are likely cosmetic upgrades for the JDM version of the hybrid, including a rear spoiler, front spoiler lip, extended side skirts and a selection of wheels ranging from 15 to 18 inches. Keyes Hyundai in northern Los Angeles has met the requirements to sell the hydrogen-powered CUV. So far, Hyundai has delivered more than 75 Tucson Fuel Cell vehicles, which have logged almost 700,000 miles on southern California roads. "Keyes Hyundai is thrilled to be added as a qualified dealer for Hyundai's zero-emissions Tucson Fuel Cell hydrogen electric vehicle," says David Kohan, the dealership's general manager. "Our location in the northern Los Angeles region makes it even more convenient for local residents to conveniently acquire their new Tucson Fuel Cell CUV, helping reduce greenhouse gas emissions." Advertising firms have done an admirable job convincing consumers that the easiest way to find a best-in-segment car or truck is by looking at a few key metrics. In the most elementary terms, the vehicle with the highest horsepower, most gears in its transmission housing, lowest acceleration times and best fuel economy most certainly must be the class benchmark.
Yet as the commercials and billboards continue to drive that deceitful message, Toyota is betting shoppers in the subcompact segment are a bit more discerning. The Japanese automaker has just launched its updated 2015 Yaris, a three- and five-door offering that bucks the innovation and performance trends by offering what Toyota feels that entry-level buyers actually desire - reliability, practicality and a low sticker price.
It's sweltering in the tropical Hawaiian sun as I check out the deeply refreshed 2015 Yaris SE. This five-door hatchback, a range-topping version of the company's subcompact "sporty hatch" (Toyota's words, not mine), builds on the new-in-2012 generation by wearing new front and rear fascias, redesigned headlights and some attractive new wheels for the upcoming model year.
