GM being sued over imploding Bosch fuel pumps in Duramax diesel trucks

Texas-based law firm Hilliard Martinez Gonzalez (HMG) this week filed a class-action lawsuit against General Motors over an alleged issue with Bosch CP4 fuel pumps. The suit claims Bosch designed the CP4 pump to work with European diesel fuel, which is thicker than U.S. diesel. When GM installed that pump in the 6.6-liter Duramax engine used from the 2011 to 2016 model years, the lawsuit claims the thinner U.S. fuel didn't provide enough lubrication, allowing air pockets to form in the fuel pump. That, in turn, allegedly let metal rub against metal inside the pump, causing the pump to eventually disintegrate and "send thousands of metal shards into the fuel injection system and every part of the engine." The Detroit News reported on the most recent lawsuit filed in Michigan's Eastern District Court, but the case is another piece of nationwide legal maneuvering going on since at least last September. Every U.S. truck maker used the Bosch CP4 fuel pump, and HMG originally went after all of them, as well as Bosch. On September 30, 2018, HMG filed a class-action suit in Texas on behalf of eight plaintiffs. The law firm wanted to prosecute the affair under RICO — the Racketeer Influenced and Corrupt Organizations Act — and named 10 defendants: FCA US LLC, FCA North America Holdings, LLC, F/K/A Chrysler Group, Fiat Chrysler Automobiles, N.V., Ford Motor Company, General Motors LLC, Robert Bosch GmbH, Robert Bosch LLC, VM North America, Inc., and VM Motori S.P.A.  The firm filed another suit in Florida on Nov. 2, 2018, against the same 10 defendants, again under the RICO statute, this time on behalf of more than 30 plaintiffs. We don't know how many other suits might have been filed, but the two suits mentioned apparently didn't have legs — the courts dismissed both quickly. So HMG shifted its strategy away from the RICO angle, and focused its efforts on GM, filing suit in California on Nov. 20, 2018. Instead of trying to catch 10 fish with a small net, HMG wants to score one fish with a big net. The results have borne more promise for the plaintiffs. In July this year, a judge in California denied GM's motion to dismiss, noting "the alleged defect is central to the vehicleÂ’s function." This latest suit filed on Aug. 6 in Detroit singles out GM again.  The Bosch CP4 is known to be problematic, however.

The apps also include an array of how-to information and instructional videos, offer push notification for important updates like maintenance offers and recall alerts, and allow customers to schedule test drives and receive quotes from their local dealers for new vehicles. But that's just the tip of the proverbial iceberg. The FCA Owner apps also feature an augmented reality function that helps drivers identify instrument-panel icons. There's a Parking Reminder feature that helps drivers remember where they parked their car, guides them back to their parking spot and tracks the time left on the meter. Finally, there's an Accident Assistant feature that helps drivers record the specifics of an accident, upload insurance information and take photos of the scene. It'll even help find the closest certified collision repair facility, schedule an appointment and access roadside assistance. The apps are available for any Chrysler, Dodge, Ram, Jeep, Fiat or Alfa Romeo built from 2011 till today, and are available for either iOS or Android. If you've got more than one FCA vehicle in your garage, you needn't download multiple versions of the app as they'll work on any model the Italian-American automaker offers. Star Trek actor's death may be linked to Jeep shifter issue

The tragic death of Anton Yelchin on Sunday may have resulted from a known design flaw with his Jeep Grand Cherokee. The 27-year-old actor, best known for playing Pavel Chekov in the latest Star Trek movies, was reportedly crushed when his vehicle rolled backwards down the driveway in front of his house, pinning him against a brick pillar and metal gate. The 2014-15 Grand Cherokee was one of three models (alongside the Dodge Charger and Chrysler 300 sedans) that Fiat Chrysler recalled this past April due to roll-away risk. The vehicle was equipped with an unintuitive "e-shifter" that didn't deliver the usual tactile response of being shifted into position, leading to numerous drivers exiting the vehicle mistakenly thinking that it was in Park. The problem was reported to have resulted in 41 injuries – and now possibly Yelchin's death as well. The manufacturer stated at the time of the recall that "the vehicles involved in these events were inspected and no evidence of equipment failure was found." It determined that while the vehicle warned occupants if the driver's-side door was opened while the engine was running and the transmission not in the Park position, such measures may have been insufficient. Its remedy for the problem involved updating the vehicle software to better warn drivers in such an event, and changing the design for subsequent models. "Regarding the recall," an FCA spokesman told Autoblog, "I can confirm notices were mailed to affected customers. Included in those notices were tip sheets describing proper operation of the shifter. This supplemental information echoes the instructions in the owner's manual." Yelchin was born March 11, 1989, in St. Petersburg, Russia. His parents were a figure-skating pair, and defected to the United States when Anton was just six months old. In the prime of his career, Yelchin had several films currently in development, including Star Trek Beyond, set to reach theaters next month. His body was reportedly discovered by friends when he didn't show up for rehearsal. Related Video:
