GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2015 Chevy Impala Bi-fuel burns CNG, starts at $37,385*

Currently, the only natural-gas-powered passenger car offered for sale by an OEM in the US is the Honda Civic Natural Gas. Starting this fall, that long-running CNG car will be joined by a CNG-burning 2015 Chevy Impala for both fleet and retail customers. General Motors announced today that the car will start at $37,385, plus an $825 destination charge. That comes to $38,210 before taxes and options. Those options include two trim lines, the base LS and the upper-level LT. Chevy doesn't break out the details in the press release announcing the price, but you can see the trim details for the standard gas-powered 2014 Impala here. Exact information on the 2015 models is not available just yet, but GM spokesman Chad Lyons told AutoblogGreen that the equipment that you see listed on the site for 2014 is "almost exactly the same" as what will be available for 2015. The 2015 Impala gets around 19 city mpg on CNG, but official EPA numbers are not yet available. That means the LS will come with 18-inch aluminum wheels, electric variable-assist power steering, projector-beam headlamps, and 10 air bags. The LT adds an eight-inch touch screen with MyLink, premium Cloth interior and dual-zone automatic climate controls. The cost for this upgrade is unspecified. For CNG purposes, we can ignore the numerical prefix used for the gas-powered LT trims, since that denominates the engine type, and all the CNG models use a 3.6-liter engine with hardened valves and valve seats that can better handle natural gas. The trunk capacity also drops from 18.8 cubic feet to 10 cu .ft. in order to fit in the CNG tank that holds the equivalent of 7.8 gallons of gas. That amount of CNG should move you 150 city miles, which is around 19 mpg, but official EPA numbers are not yet available. With the addition of the gasoline on board, the overall range is 500 city miles. The car burns CNG when available and switches to gas with "no interruption" either when the tank is empty or when the driver selects the gas tank. Find more details in the press release below. GM says the CNG Impala will will be available nationwide this fall. CNG is a growing fuel in the US, thanks in part to fracking. The Civic Natural Gas, which starts at $26,640, is growing towards a nationwide availability. Next year, for example, the Shell Eco-marathon Americas in Detroit will allow CNG for the first time. Coincidentally, the week we had the 2015 Chevrolet Silverado 1500 Custom Sport a friend asked, "What would you buy if you could only have one vehicle for everything?" After a week's driving and trailer hauling, very close to first choice would be an American pickup. They're all so good now, you can't lose. And as we found in the Chevy you can go anywhere and haul anything, and you pay no penalty for capability until you try to find an open space on the street to park. Nicely equipped versions like the Custom Sport aren't cheap, but if you need a truck and you like the look of this one, it is really good. Driving Notes The cabin is big and inviting, and everything in it is big and inviting. The materials are nice enough to look and feel swanky but not so lavish that you're afraid to get them dirty. The seats are sized for adult male bears but they don't swallow you up. The sunroof is big enough to be an observatory. It's also quiet. The only time it gets mildly unruly is when you call for power and the engine has to downshift a few gears, otherwise you don't hear the exhaust unless you roll down the window. It looks like it was designed with a T-square. I quite like it, the body-colored bumpers toning things down, the 20-inch wheels doing a much better job of filling those ample arches than the standard 17-inchers. The truck is built for people who take their work and all their gadgets with them. The front console has three USB ports, two 12-volt cigarette lighter ports, and a three-prong 110-volt outlet. The giant cubby at the base of the console has an insert to hold a clipboard or a small tablet. The abyss under the center armrest has one more 12V cigarette lighter, two more USB ports, an SD card reader, and another specialized holder for something the size of a small tablet. There's a WiFi hotspot so the streaming never has to stop. The Chevrolet navigation was trouble-free as usual, and you can input destinations on a QWERTY touchscreen keyboard. Every nav system should be so solid. The Silverado has some of the best feature implementations we've encountered in any vehicle. The lane departure warning and park assist systems don't vibrate the steering wheel, they vibrate the seat. The left, right, and middle of the seat bottom will pulse as necessary, an intuitive, peripheral way to deliver a message that doesn't interrupt your primary focus. The rear-view camera is no longer offset, it's centered.
