US prepares to sue Fiat Chrysler over diesel emissions testing

NEW YORK - The Justice Department plans to file a civil lawsuit against Fiat Chrysler Automobiles NV over excess diesel emissions as early as this week if no agreement is reached with the Italian-American automaker, two sources briefed on the matter said on Wednesday. The Environmental Protection Agency in January accused FCA of illegally using undisclosed software to allow excess diesel emissions in about 104,000 cars and SUVs, the result of a probe that stemmed from regulators' investigation of rival Volkswagen AG. The EPA and California Air Resources Board have been in talks with FCA about the excess emissions and whether the agencies would approve the sale of 2017 FCA diesel models. A federal judge in California has set a May 24 hearing on a series of lawsuits filed by owners of vehicles against Fiat Chrysler and the Justice Department is expected to file its action by then if no agreement is reached. FCA said on Wednesday it believed that any litigation would be "counterproductive" to ongoing discussions with the EPA and California Air Resources Board. The company added that "in the case of any litigation, FCA US will defend itself vigorously, particularly against any claims that the company deliberately installed defeat devices to cheat U.S. emissions tests." The Justice Department took the same procedural step in early 2016 against Volkswagen, nearly four months after the German company admitted using software to emit excess diesel emissions in nearly 500,000 vehicles. The Justice Department has had an ongoing criminal investigation into FCA's conduct since last year, Reuters reported in January. The probe has turned up internal emails written in Italian and other documents about engine development and emissions issues, sources briefed on the probe said. U.S. regulators said FCA failed to disclose engine management software in 104,000 U.S. 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3.0-liter diesel engines. The European Commission has launched legal action against Italy for failing to respond to allegations of emission-test cheating by Fiat Chrysler in a procedure that could lead to the country being taken to court. The EPA has said the maximum possible fine against FCA could be $4.6 billion. In February, FCA said it had received requests for information and subpoenas from U.S. federal and state authorities, including the Securities and Exchange Commission, for diesel issues.

VW confirms Audi's emissions test transmission anomalies

Just a week after reports that the California Air Resources Board (CARB) found an emissions cheat in some Audi automatic transmission software programs, parent company Volkswagen has come clean. As reported by Reuters, VW's response to an article by Munich's Sueddeutsche Zeitung stated that the adaptive shift functionality can "lead to incorrect and non-reproducible results." Adaptive shift programs alter the characteristics of a vehicle's transmission to suit different driving styles. Gentle driving will result in earlier shifts and lower engine revs, while hard-charging on the pedals and steering will make the transmission more responsive and hold gears longer. That adaptation can change over time or even on a short-term basis. And it can save fuel. The difference in this case is that is seems that the Audi transmissions were specifically programmed to detect emissions test conditions. As we explained in a previous article, one of those test conditions is keeping the wheel straight. Turning more than 15 degrees shuts the test mode off. According to Reuters, the US government is trying to determine whether this classifies as an emissions cheat device, although VW, Audi, and the EPA have not commented on the record. An inside look at VW's new California R&D center

Less than two months ago, the Volkswagen Group opened a new facility in Oxnard, California (about an hour's drive west of Los Angeles). The $27 million investment, touted as Test Center California (TCC), serves as a research and development lab testing emissions for all brands under Volkswagen's umbrella, including its newest member, Porsche. While still not fully operational, we toured the new 64,000-square-foot building last week and had a first-hand opportunity to see just how much work is involved testing engines and meeting increasingly stringent government emissions standards.
Replacing a similar facility established in 1990 in Westlake Village (about 20-minutes east of the new location), our guide explained how Oxnard was chosen for its temperate climate, varied regional terrain for test drives and low altitude. (The area is only a few feet above sea level - a critical parameter when instrument testing emissions.) The new facility is capable of analyzing hundreds of vehicles, prototypes and customer-owned vehicles, annually.
Most interesting to us was the huge stainless steel climate chamber, with a massive four-wheel dynamometer that allows VW to test running vehicles in both scorching desert and freezing climates without ever leaving the building (an Audi Q7 was running in place during our visit). We were also mesmerized by the countless storage tanks and intricate plumbing of chemicals, stored in both liquid and gas states, needed to perform the variety of tests. Lastly, we took a look at Bugatti's service center on the west coast, located completely within the new center. While there were no supercars on site, the facility is equipped with plenty of spare forged wheels (mounted with expensive Michelin PAX tires) and a Veyron-specific repair jig that allows the vehicle to be completely disassembled, if needed. It is a shame that the facility, which set off all of our automotive geek alerts, is closed to the public.
