US prepares to sue Fiat Chrysler over diesel emissions testing

NEW YORK - The Justice Department plans to file a civil lawsuit against Fiat Chrysler Automobiles NV over excess diesel emissions as early as this week if no agreement is reached with the Italian-American automaker, two sources briefed on the matter said on Wednesday. The Environmental Protection Agency in January accused FCA of illegally using undisclosed software to allow excess diesel emissions in about 104,000 cars and SUVs, the result of a probe that stemmed from regulators' investigation of rival Volkswagen AG. The EPA and California Air Resources Board have been in talks with FCA about the excess emissions and whether the agencies would approve the sale of 2017 FCA diesel models. A federal judge in California has set a May 24 hearing on a series of lawsuits filed by owners of vehicles against Fiat Chrysler and the Justice Department is expected to file its action by then if no agreement is reached. FCA said on Wednesday it believed that any litigation would be "counterproductive" to ongoing discussions with the EPA and California Air Resources Board. The company added that "in the case of any litigation, FCA US will defend itself vigorously, particularly against any claims that the company deliberately installed defeat devices to cheat U.S. emissions tests." The Justice Department took the same procedural step in early 2016 against Volkswagen, nearly four months after the German company admitted using software to emit excess diesel emissions in nearly 500,000 vehicles. The Justice Department has had an ongoing criminal investigation into FCA's conduct since last year, Reuters reported in January. The probe has turned up internal emails written in Italian and other documents about engine development and emissions issues, sources briefed on the probe said. U.S. regulators said FCA failed to disclose engine management software in 104,000 U.S. 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3.0-liter diesel engines. The European Commission has launched legal action against Italy for failing to respond to allegations of emission-test cheating by Fiat Chrysler in a procedure that could lead to the country being taken to court. The EPA has said the maximum possible fine against FCA could be $4.6 billion. In February, FCA said it had received requests for information and subpoenas from U.S. federal and state authorities, including the Securities and Exchange Commission, for diesel issues.

KBB: VW diesel prices have dropped 16%

There are a lot of post-scandal theories and metrics concerning Volkswagen's performance during the diesel emissions scandal, although none of them has created a clear picture of where things are headed. Kelley Blue Book has a few more to add to the spreadsheet, though, finding that average auction prices for VW diesels and Internet shoppers perusing them have both gone down in the past four weeks on KBB.com. Auction prices on the site are down an average of 16 percent for VW oil burners, which compares to a decline of 2.9 percent for gas-powered VWs. Shoppers are still on the lookout, though, even if the numbers are slightly reduced. Overall, "new-car shopping activity" for the small-capacity VW diesel offerings is down 2.4 percent, a number held partly in check by searches for the Jetta SportWagen being up by 3.7 percent. Shoppers are looking harder at the Audi A3 diesel, too, its activity up 1.6 percent. The Golf, though, is down 3.7 percent and the Golf SportWagen down 6.2 percent. Shoppers leaving the diesel fold aren't necessarily going for high-mileage options, either, KBB saying that the Ford Fusion and Honda Civic are quick alternatives to the Jetta TDI, while the Mercedes CLA and BMW 2 Series are getting new looks from those interested in the Audi A3 diesel. Funnily enough, in light of dieselgate, Volkswagen is one of the few brands (along with Volvo and Subaru) to preserve the notion that you don't need a fuel-sucking SUV to meet your life-carrying needs. And, yes, VW's history of addressing off-road desires with all-wheel-drive dates to the mid-1980s with the Quantum Syncro (a.k.a. Passat) and Golf Country – the latter, sadly, never came stateside. The latest offering toward this effort is the 2017 Volkswagen Alltrack. What's an Alltrack? It's a slightly lifted, cladded, and butched-out version of the Golf Sportwagen (yes, formerly known as a Jetta). Not to steal Alltrack's thunder, but starting in 2017 you can also get the standard Sportwagen with 4Motion AWD, which is basically the same running gear for less money. The Alltrack starts at $26,950; the 4Motion Sportwagen starts at $24,930, both with the dual-clutch automatic available at launch. Any discussion of tall wagons brings Subaru immediately to mind, both with the Outback and the Impreza-based Crosstrek. The Volkswagen Alltrack sits between the two in size at 180.2 inches long – 5 more than the Crosstrek and 9.4 inches shorter than the Outback. The 2017 Subaru Outback starts at $25,645, and VW's comparisons focus on the Outback, which is understandable given the similar starting price. A bare-bones Crosstrek starts at $22,245, but quickly gets into Golf price overlap. The Alltrack and the 4Motion Golf Sportwagen are superior daily drivers to the Subaru, whether you're doing an emergency lane change or just trying to merge onto the interstate. Meanwhile, the Crosstrek doesn't have the refinement of the VW. Can we fault Subaru though? It's set a sales record every year in a row since 2010 and is looking at about triple the sales volume of VW's Golf for 2016. So we'll stick to telling you what we think of the Alltrack and let the dealers fight for your dollars. First thing's first. Yes, you can have the Golf Sportwagen and even the Alltrack with a manual six-speed gearbox. The seven-speed DSG automatic is very good, but it's worth noting that any manual gearbox is a rarity these days, especially when we're not talking about a two-seat sports car. You will have to wait until early 2017 for that option, but it also saves you $1,100 off both models. Second, the Alltrack and 4Motion Sportwagens get identical engines. Whether manual or DSG, VW's EA888 turbocharged 1.8-liter four-cylinder is under the hood.
