Toyota calling for independent, industry-wide Takata airbag testing

The initiative is still very new, and there's no set timeframe for this third-party testing to begin. With Takata's airbag inflator recall expanding nationwide soon, the scope of this safety campaign is only growing, and is set to affect millions of additional vehicles. Toyota thinks that it can help, though. The Japanese automaker has announced an initiative to get all of the affected companies to band together to fund independent, third-party testing of the faulty components. The goal of this work is to "ensure the inflators that require replacement are accurately identified and promptly fixed," according to Toyota. All of the data would be shared among the participating automakers to better understand the causes of these problems, which still aren't entirely known, and come up with the best way to repair the affected vehicles. "By combining our collective efforts behind a coordinated, comprehensive testing program, we believe we can achieve greater results. Together we will be better equipped to address this issue more rapidly for all customers," said Simon Nagata, President and CEO, Toyota Motor Engineering and Manufacturing North America, in the company's release. According to Toyota spokesperson Cindy Knight speaking to Autoblog, the initiative is still very new, and there's no set timeframe for this third-party testing to begin. The automaker's first step is simply getting the word out that it's looking for partners. She said Toyota "has spoken with colleagues in the industry" about setting up the independent evaluations and specifically said the company has already reached out to Honda and Ford about possibly working together on this. Honda also released a statement calling for similar third party testing, and when reached for comment about Toyota's proposal, Ford spokesperson Kelli Felker responded: "Ford takes the safety of our customers very seriously. We plan to join the proposed industry wide effort to investigate and develop solutions to address this critical issue. We look forward to discussing next steps with NHTSA and other automakers." Kayaba, Sumitomo to pay millions for price-fixing in US

Kayaba Industry Co, which does business in the US as suspension parts maker KYB, and Sumitomo Electric Industries are facing payments in the millions to settle price-fixing cases about the components that they make. As part of the Department of Justice's ongoing crackdown of price fixing in the auto industry, KYB agreed to pay $62 million and pleaded guilty to conspiracy to set the cost of shock absorbers from the mid '90s through 2012. The company allegedly worked with co-conspirators to keep the cost of the parts high, and those components then made it into vehicles from Honda, Kawasaki, Nissan, Subaru, Suzuki, and Toyota. "Any collusive agreement among competitors to restrict price competition undercuts our free enterprise system and violates the law," said Carter M. Stewart, US Attorney of the Southern District of Ohio, in the DoJ's announcement. Over the past few years, the DoJ has brought cases against 37 parts suppliers and 55 executives, leading to over $2.6 billion in fines. The investigations haven't always been so successful – some of the Japanese execs fled from the US to avoid prosecution. Critics allege that price fixing is simply how business is done. According to Automotive News, Sumitomo Electric Industries is also facing a $50 million settlement in a civil lawsuit that's related to price fixing of parts like wiring harnesses and heater control panels. The plaintiffs include owners and dealers that purchased vehicles with these parts. The company asserts that the violations are from before 2010, and it now has different process in place to avoid further violations. KYB Agrees to Plead Guilty and Pay $62 Million Criminal Fine for Fixing Price of Shock Absorbers Kayaba Industry Co. Ltd., dba KYB Corporation (KYB) has agreed to plead guilty and to pay a $62 million criminal fine for its role in a conspiracy to fix the price of shock absorbers installed in cars and motorcycles sold to U.S. consumers. According to charges filed today, KYB conspired from the mid-1990s until 2012 to fix the prices of shock absorbers sold to Fuji Heavy Industries Ltd. (manufacturer of Subaru vehicles), Honda Motor Co. Ltd., Kawasaki Heavy Industries Ltd., Nissan Motor Company Ltd., Suzuki Motor Corporation and Toyota Motor Company, including their subsidiaries in the United States.

Toyota's $1.6B unintended acceleration settlement approved

Toyota is now one step closer to putting its unintended acceleration woes behind it as it has received approval from the US District Court for the Central District of California to settle loss-of-value claims to vehicles associated with the 2009-2010 recalls.
As we reported back in May, the Toyota settlement is worth $1.63 billion, which, according to Bloomberg, includes a payout of $757 million to affected owners, $227 million to attorneys and an additional $875 million for vehicle upgrades. (We did the math, too, and that totals $1.859 billion, but there is no justification for the discrepancy. Fuzzy math, eh?)
Based on the estimated 22.6 million vehicles said to be included in this suit, that would make the average payment about $33.49 per vehicle, but the article says that owners, lessees and even renters will receive varying amounts ranging from $9.74 up to as much as $10,000. This settlement does not affect suits filed for personal injury or wrongful death.
