Toyota settles first wrongful death suit related to unintended acceleration
Mon, 21 Jan 2013Toyota's sales seem to have rebounded from the unintended acceleration issues from 2009 and 2010, but the automaker is far from done dealing with this situation. Following a settlement worth up to $1.4 billion for economic loss to affected vehicle owners, Toyota has settled rather than going to trial in a wrongful death lawsuit stemming from an accident in Utah in 2010 that left two passengers dead. This isn't the first case in which Toyota has settled, but it was the first among a consolidated group of cases being held in Santa Ana, CA.
According to The Detroit News, this case was scheduled to take place next month, and it was for a November 2010 incident in which Paul Van Alfen and Charlene James Lloyd were killed in a Camry when, based on findings by the Utah Highway Patrol, the accelerator got stuck causing the car to speed out of control and hit a wall; the terms of the settlement were not announced.
The article says that while Toyota will settle on some cases, it doesn't plan on settling on all of them as it still wants to be able to "defend [its] product at trial." This will probably be the case in suits claiming that software for the drive-by-wire accelerator was the cause of an accident in a Toyota or Lexus vehicle. The question of whether or not the electronic accelerator played any role in this problem has been a hot-button topic since the beginning. Toyota has issued recalls in the past to attempt to prevent unintended acceleration caused by trapped floor mats and faulty accelerator pedals, but it also says driver error was to blame in some instances.

VIDEO TRANSCRIPT [00:00:00] Hello everyone. Welcome to another Autoblog Daily Driver. This is Sebastian Blanco coming to you from behind the wheel of a 2015 Toyota Avalon Hybrid XLE Premium. This is the silver metallic and light gray version. Comes in at $38,455. It has an Entune Premium audio setup here. It's a Toyota. It's a hybrid, which probably makes you think of a Prius. The Avalon [00:00:30] and the XLE and the Premium, what we're really dealing with here is a world's plushiest, comfiest bigger Prius. It's a very different kind of car, with the body style, but you've got a lot of similarities if you've spent any time in a Prius. The fuel economy of this Hybrid on the official scale is 40 miles per gallon combined, 40 in the city and 39 on the highway. I've driven it over 400 miles this week and my average was 34.3 miles per gallon. [00:01:00] Much lower than the numbers would suggest and there's really no excuse for that. I was driving with the cruise control on, mostly on the highway, the weather is fine. This should have been an easy 39, but maybe that's the fault of the cruise control. The sport mode in this car for me has been kind of a joke. When I was interacting with the car in a more discernible manner, I couldn't tell much difference. This isn't the kind of car that you want when you're dealing with sport mode. [00:01:30] You know what you're getting with this car. It's a little more luxurious, not quite Lexus level, but definitely the higher end for a Toyota. It's nice if you like these sort of cars. Toyota FT-86 Open Concept leaves us feeling flushed
Wed, 20 Nov 2013When last we checked in on our topless would-be hero, the Toyota FT-86 convertible had been reportedly placed on "indefinite hold." That was back in early October, not long after Toyota had trotted out the rear-wheel-drive canvasback to Scion dealers as a possible future product carrot if they decided not to turn in their franchises. And yet, we're here at the Tokyo Motor Show, where Toyota has taken the time to at least repaint the FT-86 Open Concept in "Flash Red," if not build a whole other car (the original Geneva showcar was white). It's enough to make our heads spin like a teenager on the verge of a breakup. Will they? Won't they?
At this point, we still don't know any more than you do - the last word we heard out of Toyota was not encouraging, although the story was that the program could still be fast-tracked if management had a change of heart. As the car has never been seen before in Japan, perhaps Toyota is merely extending its domestic audience a courtesy view before it lines this showcar in mothballs, or maybe they're still trying to make a decision on its fate and gauging public reaction on the homefront.
Interestingly, in a new story published today, Automotive News quotes Subaru brand boss Yasuyuki Yoshinaga downplaying the likelihood of a production model, saying flatly "We make the car, so if we don't make it, it can't happen." The executive went on to note, "Our engineering department told me that losing the entire roof requires a complete redesign of the structure. It would need a big change." Given that such a car would probably trade in rather small volumes, that sounds like a significant hurtle.
