Ex-Nissan chairman Carlos Ghosn indicted, may remain in jail for months

TOKYO — Nissan's ex-chairman Carlos Ghosn was charged Friday with breach of trust, according to the Tokyo District Court, making the star executive's release unlikely for months. Ghosn, arrested Nov. 19, was earlier charged with falsifying financial reports in underreporting his income by about 5 billion yen ($44 million) over five years through 2015. Ghosn; Greg Kelly, another Nissan executive; and Nissan as a legal entity also were charged Friday with additional underreporting of income, from 2015 through mid-2018. Ghosn's lawyer Motonari Ohtsuru said he would request that Ghosn be granted release on bail. His detention period for the breach of trust allegations was due to expire Friday. Kelly and Nissan were not charged with breach of trust. Those allegations center on Ghosn's handling of investment losses and payments made to a Saudi businessman. Ghosn, 64, says he's innocent. Suspects in Japan are routinely held for months until trials start, and Tokyo prosecutors maintain that Ghosn, a Brazilian-born Frenchman of Lebanese ancestry, is a flight risk. Earlier this week Ghosn told a Tokyo court he was innocent, in his first public appearance since his arrest, and appealed for his detention to end. But the court rejected that request. "I have a genuine love and appreciation for Nissan," Ghosn told the court. "In all of my efforts on behalf of the company, I have acted honorably, legally and with the knowledge and approval of the appropriate executives inside the company." He said the compensation was never decided on, the investment deal never resulted in any losses to Nissan, and the payments to the Saudi businessman were for legitimate services related to dealers and investments in the Gulf. Ghosn, who appeared much thinner than before his arrest, came down with a fever the day after his court appearance, but has since recovered, Ohtsuru, the lawyer, said. His wife Carole Ghosn issued a statement overnight out of Paris, expressing concern over his sickness. "I am pleading with the Japanese authorities to provide us with any information at all about my husband's health. We are fearful and very worried his recovery will be complicated while he continues to endure such harsh conditions and unfair treatment," she said. Apart from prosecutors, only embassy officials and Ghosn's lawyers are allowed to visit him. Such visits were canceled Thursday but resumed Friday.

Junkyard Gem: 1996 Nissan Quest XE with 338,549 miles

When I hit the junkyard, I always look for vehicles with impressive final figures showing on their odometers. I find so many Hondas and Toyotas with better than 300,000 miles that I don't consider them especially noteworthy (the exception being super-low-spec cheap models, such as a Tercel or Civic VX), and it goes without saying that the bar is quite high for Mercedes-Benzes as well. It has been surprisingly difficult to find discarded Nissans that made it past the 300k mark; today's Junkyard Gem is just the fourth I've documented. The highest-mile junked Nissan I'd found prior to today's minivan is a 1994 Maxima with 364,238 miles, followed by a 1987 Maxima with 341,176 miles and a 1986 200SX with 309,222 miles. Keep in mind that Nissan didn't go to six-digit odometers on most of its US-market cars until the early 1980s, and then went to tough-to-read-in-the-junkyard electronic odometers in the early 2000s; this means the pool of potential high-mile Nissans is limited to about the 1983-2000 range of model years. Ford has just as much right to claim credit to this van's impressive mile total as does Nissan, since the Quest was a collaboration between Ford and Nissan that also produced the Mercury Villager; this van was built by Ford at the Ohio Assembly plant. The Quest/Villager platform was derived from the Maxima's, and the engine is pure Nissan: a 3.0-liter VG30 V6 rated at 151 horsepower. The only transmission available in the first-generation (1993-1999) Quest/Villager was a four-speed automatic. This one appears to have been sold new at Landrum Nissan in Pueblo. The rear glass has been painted flat black, possibly to keep prying eyes from seeing valuable cargo. The rear seats are long gone, so this van probably hauled cargo for much of its long life. The front interior seems to be in good shape. Why is this van here? There's body damage on the left rear and right front, suggesting a crash that may have bent the suspension past the worth-fixing threshold. Nissan Silvia smuggler faces maximum 20-year, $250k sentence

Thinking about trying to sneak a JDM car into the United States? Better think twice, because according to the Clarion-Ledger, one man in Mississippi has found himself in hot water for smuggling a Nissan Silvia into the country. Few details of the case are available, but the Silvia has a strong following among JDM enthusiasts despite (or perhaps because of) the fact that it was never officially sold Stateside. The low-slung coupe was offered in Japan and other markets from 1964 through 1968 and again from 1974 to 2002. Though it was powered principally with a four-cylinder engine, its front-engine/rear-drive layout made it popular on the tuning and drifting scenes. The 240SX that was offered Stateside was related, but not strictly speaking the same vehicle. It's likely because the Silvia was never certified for use on American roads (and because the culprit apparently didn't go through the correct channels) that the unidentified man in Ocean Springs, MS, is reportedly facing a $250,000 fine and up to 20 years in prison. Here's hoping whatever else he's got in the driveway is just as fast, because it looks like he'll have a lot of time to make up for.
