Carlos Ghosn, a year after arrest, still seeks trial date and access to evidence

TOKYO — A year after his arrest, Nissan ex-Chairman Carlos Ghosn remains stuck in Tokyo under stringent bail conditions and without a trial date as he seeks access to a trove of Nissan emails and other evidence to fight charges of financial misconduct. His lawyers have asked a court to grant access to 6,000 pieces of evidence collected from Nissan such as electronic communications, which they say is crucial for a fair trial, showed an Oct. 4 court filing seen by Reuters. The once-feted executive has spent 129 days in detention since his arrest shortly after his private jet touched down at a Tokyo airport on Nov. 19, 2018. He faces four charges — which he denies — including hiding income and enriching himself through payments to dealerships in the Middle East. Nissan sacked Ghosn, saying its internal investigations revealed misconduct ranging from understating his salary while he was its chief executive, and transferring $5 million of Nissan funds to an account in which he had an interest. An earlier court ruling allowed prosecutors to hand back evidence to Nissan during pretrial wrangling over witnesses and evidence similar to the U. S. discovery process. If prosecutors are "given the freedom to unilaterally delete the collected evidence and return it to relevant parties, this is equivalent to granting the investigative agencies the right to destroy evidence," showed the filing to the Tokyo District Court. The lawyers also asked the court to rescind the earlier ruling, saying some evidence could be erased by Nissan to protect confidential business information. They argued the "ruling deprives Mr. Ghosn of his right to receive a fair public trial by an impartial court," as it enabled prosecutors to view and use the evidence and withhold it from the defense. Prosecutors are not required to hand over all evidence they or the police gather during investigations unless ordered by the court, unlike in the U.S. discovery process where prosecutors and defense lawyers disclose the evidence they intend to present in court. A spokeswoman for the Tokyo prosecutors' office said the office could not comment on individual cases. A Nissan spokeswoman declined to comment. Ghosn's lawyers have also asked the court to dismiss all charges against him, accusing prosecutors of colluding with government officials and Nissan executives to oust him to block any takeover of the automaker by French alliance partner Renault SA, of which Ghosn was also chairman.

Nissan, Infiniti issue recall for replacement Takata air bags in older models

Nissan and Infiniti are recalling older vehicles that were repaired after collision damage to address problems with Takata replacement air bag inflators that were potentially installed. The overall campaign population is difficult for Nissan to pin down because the only vehicles impacted would be those that Nissan and Infiniti know to have been serviced with the replacement units in question. Officially, the recalled population numbers just 375, but Nissan says more than 18,000 cars could have the defective parts installed.  Drivers of 2001-2003 Nissan Maximas, 2002-2006 Nissan Sentras, 2007-2012 Nissan Versa Sedans/Hatchbacks, 2002-2003 Infiniti QX4s and 2006-2010 Infiniti M35s/M45s that had their vehicles repaired after a collision or theft should be aware that these deadly replacement parts may have been used.  "The potentially affected inflators may have been installed on vehicles after final remedy repair completion under the vehicle recalls as part of a subsequent theft or collision repair," Nissan's notice said. "Vehicles that received the subject parts prior to December 9, 2016, are not affected as they would have been subsequently included in the final remedy recalls and replaced with a final remedy driver and/or passenger air bag inflator. Nissan has identified 18,422 vehicles that may have had these parts installed during service." The air bag inflators in question were inadvertently shipped to service inventory between December 9, 2016 and November 12, 2021 — after the dangers of Takata's inflator design were known to the industry. Nissan rowed the Note ashore [w/video]

Normally we wouldn't suggest trying to float your car on water, but Nissan has made some modifications to turn its new Versa Note hatchback into a makeshift rowing shell.
Nissan replaced the car's rear seats with a sliding rear rowing seat, modified the doors to open wider at 90 degrees and fitted a pair of oars. Most importantly, they put the whole thing on a floating platform to keep it from sinking into Eton Dorney Lake, the site of the 2012 Olympic rowing competitions in England (where the car is simply known as the Nissan Note).
Then they invited medal-winning competitive rowers Helen Glover, Sophie Hosking and Polly Swann to come along and row the thing, making use of the around-view monitor system to see where they were going. All in all it may not be quite as cool as the boats which Fiat made out of the 500 or Mini made out of its convertible, but it's still enough to float our boat.
