Ram and Jeep diesel emissions allegations spur class action lawsuits

This shouldn't come as a surprise. Last week, the EPA issued a notice of violation to FCA after it determined that Jeep and Ram installed eight undisclosed auxiliary emissions control devices on diesel vehicles. Since then US law firm Heninger Garrison Davis, LLC and Canadian firm Sotos LLP have launched class action suits on behalf of owners. These latest lawsuits are unrelated to a previous class action suit brought against FCA and Cummins over NOx emissions in 2007 to 2012 Ram models. The violation notice – and the subsequent lawsuits – covers 2014 to 2016 Jeep Grand Cherokee and Ram 1500 models equipped with the 3.0-liter turbodiesel V6, a total of about 104,000 vehicles in the US. The EPA says that while the emissions control devices aren't necessarily illegal, installing them without disclosing them to the EPA is, as they produce more emissions in real world use than in testing. Skirting certification in this way might be a violation of the Clean Air Act. FCA could see fines of up to $45,000 per vehicle, depending on the outcome of the EPA investigation. FCA denies that these are cheat devices, and has proposed software updates to bring the vehicles into compliance. As for the lawsuits, Heninger Garrison Davis says that "Fiat Chrysler marketed those vehicles as environmentally friendly with enhanced fuel efficiency, better performance, and lower emissions. Although the diesel vehicles were successfully marketed as 'clean,' their environmentally-friendly representations were deceptive to consumers." The suit seeks an undisclosed amount of compensation for owners of these vehicles. In Canada, Sotos LLP is seeking $250 million in damages on behalf of owners. This suit, filed in the Ontario Superior Court of Justice, also claims deception on the part of FCA, "resulting in losses and damage" to owners. These are similar claims to group actions against Volkswagen with regard to its diesel emissions cheating scandal. While VW is fixing or buying back many of the affected vehicles, the company is defending itself against some suits on behalf of owners, saying it expects " no decline in the residual values of the affected vehicles as a result of this issue." Don't be surprised if FCA mounts a similar defense.

Over a long enough period of time, every car model on the planet will probably have at least one example receive a Chevrolet V8. And a large number of them will have an LS-series V8, commonly found in Corvettes and Camaros from the last 20 years (plus other GM vehicles in slightly different forms). Sometimes it doesn't take very long, as is the case with the 2018 Jeep Wrangler JL. The new Jeep has only been available for a couple of months, and already a company called Bruiser Conversions is offering to install LS engines under the hood. Though Bruiser Conversions doesn't yet list exactly what specifications the engine has, it offers the LS3 in both 450- and 500-horsepower versions on the previous Wrangler JK generation. The new V8 will be fitted to the factory 8-speed automatic transmission, and the company says that the transmission will function exactly as it does with the original V6 or turbo inline-4. In addition, Bruiser Conversions says all factory gauges, cruise control, hill descent control and other electronic aids will work like they did from the factory. Pricing is currently not listed for the conversion, but the company is taking pre-orders for both in-shop installations and do-it-yourself kits. Going off the conversion costs for an older JK Wrangler, it will probably cost between $20,000 and $30,000 to have Bruiser Conversions do the installation. In the case of the JK kits, they're about $5,000 less than having Bruiser Conversions do the work. NHTSA still mulling crash tests for recalled Jeeps

Well, no one should ever accuse the government of not giving things plenty of thought. The National Highway Traffic Safety Administration is still debating whether it will retest any of the 1.56 million 1992 to 1998 Grand Cherokees and 2002 to 2007 Libertys that were part of a recall regarding fires after rear-end collisions. And yes, this debate has been going on for over a month. In other news...
The recall dustup started in early June, when Chrysler took the unusual position of refusing a recall request from NHTSA regarding placement of the fuel tank on the effected vehicles. NHTSA said a collision could cause a fire, a position Chrysler took issue with. Extensive negotiations ensued, with Chrysler agreeing to fit certain Jeeps with trailer hitches, which it said would provide some protection to fuel tanks mounted behind the rear axle in the event of a collision.
Part of the issue rests with the amount of data that needs to be processed, according to The Detroit News. NHTSA administrator David Strickland said during a Washington Auto Press Association meeting, "There's a lot of data and Chrysler is being very cooperative in giving us more data." Until that information has been sorted, it looks like re-testing will still be up for debate.
