Court puts kibosh on apartheid lawsuit against Ford, Daimler

Ford and Daimler have scored a major victory in a long-running lawsuit filed in US federal court by unnamed South African nationals. The suit alleges that both manufacturers and their subsidiaries sold their vehicles to the South African military, despite knowing that they'd be involved in violently putting down anti-apartheid protesters.
According to Reuters, South African plaintiffs filed the case under the 223-year-old Alien Torts Statute, a law which allows foreign nationals to file charges in US courts for perceived breaches of what was originally international law, but now more closely relates to violations of human rights.
And while the case - which also involves computer manufacturer IBM - has been tied up in federal courts for years, a recent case from the Supreme Court struck down a similar suit against Royal Dutch Petroleum (Shell), arguing that the ATS doesn't apply to corporations or to conduct if it occurred outside the US. In short, the law applies to individuals, but not corporations like Ford or Daimler. A US appeals court ruled that the conditions apply in this case, potentially drawing this long-running saga to a close, as the defendants will now be allowed to request that the case be dismissed in district court.

The Chinese auto industry used to be looked at as a joke full of products blatantly copied from foreign vehicles. However, companies like Qoros and others show that the country's automakers have taken big steps in terms of original design. It doesn't look like every automaker there is ready to put down the tracing paper yet, though. Case in point: The Kawei K1 pickup pictured above, which is an obvious rip-off of the Ford F-150. In fact, the company isn't even hiding it. Kawei deserves a little credit for its openness. In describing the new model, it says: "No matter the black net grille and the outline of the headlamp, even if the styles of fog lamp and engine cover, it looks the same as Ford Raptor." It also admits that spelling out the model name on the hood is inspired by Land Rover. It's available with either a 2.4-liter, gasoline-fueled four-cylinder producing 141 horsepower and 148 pound-feet of torque (elsewhere it also lists it as having 162 lb-ft) or a 3.2-liter six-cylinder diesel with 106 hp and 181 lb-ft. Regardless of engine, power is sent to the rear wheels through a five-speed manual gearbox. The trucks cost around 100,000 Yuan ($16,033). So at least the K1 is a reasonably priced knockoff. According to Car News China, the K1 is actually selling in small numbers. The company made 10,000 of them last year and even exported some to Africa and the Middle East. Kawei's factory is doubling in capacity this year to build even more. You can read more about the truck on the company's website in some very mangled English. Ford's China sales keep falling, down 30% in third quarter

BEIJING — Ford's July-to-September vehicle sales in China fell 30%, as the U.S. automaker continued to lose ground in a prolonged sales decline in its second biggest market. The Dearborn, Michigan-based automaker delivered 131,060 vehicles in China in the third quarter, Ford said in a statement. Ford's sales in China fell 35.8% in the first quarter and by 21.7% in the second quarter. In the third quarter, sales of the automaker's mass-market Ford brand fell 37.7%, while its luxury division Lincoln saw sales drop by 24.1%. It delivered around 421,000 vehicles in the first nine months of the year, according to Reuters calculations. Ford has been struggling to revive sales in China after its business began slumping in late 2017. Sales sank 37 percent in 2018, after a 6 percent decline in 2017. The automaker plans to launch more than 30 new models in China over the next three years, of which more than a third will be electric vehicles. It also said it would localize management teams by hiring more Chinese staff and aimed to improve relationships with joint venture partners. Ford has launched a series of new models in the third quarter in China, including Focus, Edge, and the electric Territory. In China, Ford makes cars through its joint venture with Chongqing Changan Automobile Co and Jiangling Motors. It has said it would partner with Zotye Automobile Co to sell lower-priced cars, but there seems to have been little progress. In a series of moves, Ford named a new president for its main local venture, Changan Ford, in August and said it would enhance its partnership with Changan through research, production and marketing cooperation in September. Ford is also planning to revamp some of its existing manufacturing facilities with Changan to localize production of its premium brand Lincoln. Changan Ford's sales down by around 33.5% in the third quarter, according to Reuters calculations based on Changan's filings. Ford rival General Motors' July-to-September vehicle sales in China fell 17.5%, to 689,531 vehicles. As GM and Ford China sales extend declines, U.S. car companies' market share of total China passenger vehicle sales fell to 9.5% in the first eight months of this year, from 10.7% in the year-ago period, according to the China Association of Automobile Manufacturers (CAAM). Over the same period, German carmakers' share has risen to 23.8% from 21.6%, and Japanese automakers' share rose to 21.7% from 18.3%.
