Court puts kibosh on apartheid lawsuit against Ford, Daimler

Ford and Daimler have scored a major victory in a long-running lawsuit filed in US federal court by unnamed South African nationals. The suit alleges that both manufacturers and their subsidiaries sold their vehicles to the South African military, despite knowing that they'd be involved in violently putting down anti-apartheid protesters.
According to Reuters, South African plaintiffs filed the case under the 223-year-old Alien Torts Statute, a law which allows foreign nationals to file charges in US courts for perceived breaches of what was originally international law, but now more closely relates to violations of human rights.
And while the case - which also involves computer manufacturer IBM - has been tied up in federal courts for years, a recent case from the Supreme Court struck down a similar suit against Royal Dutch Petroleum (Shell), arguing that the ATS doesn't apply to corporations or to conduct if it occurred outside the US. In short, the law applies to individuals, but not corporations like Ford or Daimler. A US appeals court ruled that the conditions apply in this case, potentially drawing this long-running saga to a close, as the defendants will now be allowed to request that the case be dismissed in district court.

But on the other side of the coin, the list of least reliable vehicles sometimes contains surprises.   The organization surveys its members to determine the vehicles that exhibited the most problems over the prior year. Owners are asked about creaks and rattles, the durability of parts and trim, and mechanical issues. Consumer Reports assigns a weight to each problem and then uses them to create a score, with 100 being the best. Some familiar names appear on the list of least reliable vehicles (in order with the lowest predicted reliability score at the top), but there are a few eyebrow-raising models, followed by CR's score: Ford F-150 Hybrid: 4 Hyundai Kona Electric: 5 Lincoln Aviator: 8 Nissan Sentra: 9 Ford Explorer: 16 Chevrolet Bolt: 17 Chevrolet Silverado 1500/GMC Sierra 1500: 19 Jeep Gladiator: 21 Mercedes-Benz GLE: 23 Jeep Wrangler: 24 Consumer Reports noted that sedans are the most reliable vehicle category and found that trucks are far lower on the list. That said, the survey showed that trucks from American brands tended to have better reliability scores, so it’s surprising to see GMÂ’s big two and the Ford F-150 on the list. Part of their problematic ownership experience could be due to the fact that all three trucks have received recent updates, and the Ford was completely redesigned for 2022. New tech, fresh drivetrain components, and other improvements can upset the balance of reliability and make newer models look less dependable than their older counterparts. Ford, GM still doing new business with Takata amidst airbag crisis

Lengthy vehicle development times make it difficult for automakers to cut and run from the supplier. You might expect automakers to be fleeing any connection with beleaguered supplier Takata in the wake of the company's exploding airbag inflator crisis. After all, with a Senate hearing, pending lawsuit, plummeting stock value and demand for a national recall, the tier-one supplier isn't at its strongest right now. However, years of cooperation mean that automakers are standing by Takata, and necessity may be playing a role, as well. About 39 percent of Takata's business comes from airbags, and seatbelts make up another significant chunk of the operation too, says Bloomberg. The long-term relationships and lengthy vehicle development times make it difficult for automakers to cut and run from the supplier. "Takata has so much product breadth that I don't really see that they could just disappear," said AutoPacific analyst Dave Sullivan to Bloomberg. For example, Takata helped develop the unique front center airbag with General Motors in models like the Chevrolet Traverse and Buick Enclave. Outside of safety tech, it is also a partner with Ford on the adaptive steering system available on the upcoming 2015 Edge. These long-lasting partnerships make change difficult now that there's a problem. According to Reuters, automakers claim it would take a year or longer to set up with a different supplier for replacement airbag inflators. Switching to a completely different part for the repairs might not be a viable option either, because of the engineering time needed. BMW is taking action, though. According to Reuters, the Bavarian brand is working with the supplier to move inflator production from Monclova, Mexico, to a Takata factory in Freiburg, Germany.
