Ford fights back against patent trolls

Some people are just awful. Some organizations are just as awful. And when those people join those organizations, we get stories like this one, where Ford has spent the past several years combatting so-called patent trolls. According to Automotive News, these malicious organizations have filed over a dozen lawsuits against the company since 2012. They work by purchasing patents, only to later accuse companies of misusing intellectual property, despite the fact that the so-called patent assertion companies never actually, you know, do anything with said intellectual property. AN reports that both Hyundai and Toyota have been victimized by these companies, with the former forced to pay $11.5 million to a company called Clear With Computers. Toyota, meanwhile, settled with Paice LLC, over its hybrid tech. The world's largest automaker agreed to pay $5 million, on top of $98 for every hybrid it sold (if the terms of the deal included each of the roughly 1.5 million hybrids Toyota sold since 2000, the company would have owed $147 million). Including the previous couple of examples, AN reports 107 suits were filed against automakers last year alone. But Ford is taking action to prevent further troubles... kind of. The company has signed on with a firm called RPX, in what sounds strangely like a protection racket. Automakers like Ford pay RPX around $1.5 million each year for access to its catalog of patents, which it spent nearly $1 billion building. "We take the protection and licensing of patented innovations very seriously," Ford told AN via email. "And as many smart businesses are doing, we are taking proactive steps to protect against those seeking patent infringement litigation." What are your thoughts on this? Ford (F) and General Motors (GM) have solid balance sheets, strong cash flow, solid earnings, and growing markets. By all accounts, they are smart investments. But the market is down on these stocks. Why? Some of the stupid excuses include: They are cyclical companies The Detroit 3 have lost 3.5 million in sales since 2000 The world economy is shaky GM recently filed for bankruptcy Their markets have peaked They haven't changed their ways Let's take these criticisms one by one: They Are Cyclical Companies Yes, they are cyclical. Every company is cyclical. Every industry is cyclical. Some more than others, but not every company is immune from swings in the market. Banks used to be 'non-cyclical' leader, not anymore. Airline stocks are just as cyclical as auto stocks, yet they are trading at multiples greater than the auto industry. Why? And what accounts for the irrational stock price for Tesla (TSLA)? At least Ford (F) and General Motors (GM) make money and have positive cash flows. In fact, both companies have a net positive cash position. They have more cash on hand than liabilities. Auto sales in the United States hit a record 17.5 million vehicles in 2015. During the Great Recession, Ford (F) and General Motors (GM) cut their break even points to 10 million vehicles per year. Anything above an annual U.S. volume of 10 million vehicles is profit. And what a profit they make. Sales of Ford's F-150 continues to be the best-selling vehicle in the United States for over 30 years. Detroit 3 Have Lost 3.5 million in Sales Since 2000 Automotive News reports General Motors (GM), Ford (F) and Chrysler (FCA) have lost a combined 3.5 million vehicles sales since 2000. So how can they be making more money? Two big reasons – Fleet Sales and the UAW. Fleet Sales The Detroit 3 used to own car rental companies to keep their factories running. Ford owned Hertz (HTZ), General Motors owned all of National Car Rental and 29 percent of Avis, and Chrysler, the forerunner to Fiat Chrysler (FCA), used to own Thrifty Car Rental and Dollar Rent-A-Car. The Detroit 3 owned these rental companies to have a place to sell their bad product and keep their factories running. These were low margin sales, and in many cases, were money losers for the Detroit 3. They no longer own auto rental companies.

Weekly Recap: Hackers demonstrate auto industry's vulnerability

There's always been a certain risk associated with driving, and this week cyber security came into focus as the latest danger zone when researchers demonstrated how easily they could hack into a 2014 Jeep Cherokee from across the country. The incident raised concerns over the vulnerability of today's cars, many of which double as smartphones and hot spots. During the now-infamous experiment, Chris Valasek and Charlie Miller infiltrated the Jeep's cellular connection and were able to control the infotainment system, brakes, and other functions. The hackers told the Jeep's maker, FCA US, of their findings last year, the company devised a software fix. Though Valesek and Miller hacked a Cherokee (like the one shown above), several FCA products, including recent versions of the Ram, Grand Cherokee, Dodge Durango, and Viper were also affected, illustrating potentially wide exposure that could reverberate across the sector. "For the auto industry, this is a very important event and shows that cyber-security protection is needed even sooner than previously planned," Egil Juliussen, senior analyst and research director for IHS Automotive, wrote in a research note. "Five years ago, the auto industry did not consider cyber security as a near-term problem. This view has changed." Hours after the Cherokee hacking incident was publicized on Tuesday, Sens. Ed Markey (D-Mass) and Richard Blumenthal (D-Conn) introduced legislation to direct the National Highway Traffic Safety Administration and Federal Trade Commission to establish national standards for automotive cyber security. The bill also would require vehicles to have a cyber-rating system to alert consumers how well their cars' privacy and security are defended. "Drivers shouldn't have to choose between being connected and being protected," Markey said in a statement. "We need clear rules of the road that protect cars from hackers and American families from data trackers." Though FCA and its Jeep Cherokee were in the spotlight this time, they were just the latest to showcase how automotive technology has advanced faster than safety and regulatory measures. IHS forecasts 82.5 million cars will be connected to the internet by 2022, which is more than three times today's level. "Cyber-security will become a major challenge for the auto industry and solutions are long overdue," Juliussen said.
