Federal judge orders Barra and Manley to try to resolve GM racketeering lawsuit

DETROIT — A federal judge in Detroit on Tuesday ordered the chief executives of automakers General Motors and Fiat Chrysler Automobiles to meet by July 1 to try to resolve GM's racketeering lawsuit. U.S. District Court Judge Paul Borman called on GM CEO Mary Barra and FCA CEO Mike Manley to meet in person to try to resolve a case that could drag on for years. "What a waste of time and resources now and for the years to come in this mega-litigation if these automotive leaders and their large teams of lawyers are required to focus significant time-consuming efforts to pursue this nuclear-option lawsuit if it goes forward," Borman said at the end of a hearing during which FCA asked the judge to dismiss GM's lawsuit. Borman said instead, the companies need to focus on building cars and keeping people employed at a time when the coronavirus has hurt the U.S. economy and the country is also dealing with issues of racial injustice after the death of George Floyd, a Black man whose death in police custody in Minneapolis triggered worldwide protests. GM filed the racketeering lawsuit against FCA last November, alleging its rival bribed United Auto Workers (UAW) union officials over many years to corrupt the bargaining process and gain advantages, costing GM billions of dollars. GM is seeking "substantial damages" that one analyst said could total at least $6 billion. Barra and Manley should meet, taking into account social distancing to keep them safe, to "explore and indeed reach a sensible resolution," Borman said in the hearing, which was broadcast online. It is common for judges to order parties to try to resolve disputes out of court. But it is unusual that the chief executives of two big companies be instructed to meet face-to-face, not just to settle their differences but also to serve a greater good. A GM spokesman said the No. 1 U.S. automaker has a strong case and "we look forward to constructive dialogue with FCA consistent with the courtÂ’s order.” FCA had no immediate comment. Borman said he wanted to hear from Barra and Manley personally at noon on July 1 to provide him with results from their discussion. FCA to recall nearly 900,000 vehicles that don't meet emissions standards

WASHINGTON — Fiat Chrysler Automobiles will recall 862,520 gasoline-powered vehicles in the United States that do not meet U.S. emissions standards, the Environmental Protection Agency said on Wednesday. The recall was prompted by in-use emissions investigations conducted by the EPA and in-use testing conducted by Fiat Chrysler as required by U.S. regulations, the agency said. EPA said it will continue to investigate other Fiat Chrysler vehicles that are potentially noncompliant and may become the subject of future recalls. The recall includes 2011-2016 Dodge Journeys, 2011-2014 Chrysler 200s and Dodge Avengers, 2011-2012 Dodge Calibers and 2011-2016 Jeep Compass/Patriots. Fiat Chrysler said in a statement the EPA announcement "has no safety implications. Nor are there any associated fines." "The issue was discovered by FCA during routine in-use emissions testing and reported to the agency," the company said. "We began contacting affected customers last month to advise them of the needed repairs, which will be provided at no charge." Its U.S.-traded shares were down 1 percent. "EPA welcomes the action by Fiat Chrysler to voluntarily recall its vehicles that do not meet U.S. emissions standards," EPA Administrator Andrew Wheeler said in a statement. "We will provide assistance to consumers navigating the recall and continue to ensure that auto manufacturers abide by our nation's laws designed to protect human health and the environment." Due to the "large number of vehicles involved and the need to supply replacement components — specifically to the vehicle's catalytic converter — this recall will be implemented in phases during the 2019," the EPA said In January, Fiat Chrysler agreed to a settlement worth about $800 million to resolve claims by the U.S. Justice Department and state of California that it used illegal software to produce false results on Ran and Jeep vehicles. But that incident involved diesel engines. It is awaiting the outcome of a criminal probe. The hefty penalty was the latest fallout from the U.S. government's stepped-up enforcement of vehicle emissions rules after Volkswagen AG admitted in September 2015 to intentionally evading emissions rules.

The automaker, along with Iveco and Magneti Marelli, signed a memorandum of understanding with Israel's Prime Minister's Office as part of the Israel Fuel Choices Initiative. The photos, sent by a reader to Green Car Reports, show a camouflaged Fiat 500X that appears to lack a tailpipe, suggesting it could be an EV. It was photographed on its way to Chrysler's SRT Engineering Center, which builds specialized, low-volume vehicles. The gas-powered 500X debuted in North America at the Los Angeles Auto Show last fall, so camouflage seems a bit unusual at this point if it's just a standard powertrain.
