Kurt Busch suspended indefinitely after losing appeal

NASCAR has officially suspended Kurt Busch indefinitely after he was found in violation of two specific clauses in the stock racing rulebook, specifically "Actions detrimental to stock car racing" and a "Behavioral Penalty." Earlier in the week, the State of Delaware issued an Order of Protection from Abuse against him after a case detailing alleged domestic violence committed by Busch against his girlfriend, Patricia Driscoll, reached its conclusion. Busch and his legal team have exhausted all of their appeals options, meaning the indefinite suspension is official and final. Busch will not take part in the Daytona 500, which kicks off the 2015 NASCAR season today. Regan Smith will drive the No. 41 Stewart-Haas Chevrolet today at Daytona. It's not yet clear if Busch will face criminal charges over the domestic abuse incident. A Commissioner for Kent County in Delaware found that a "preponderance of evidence" led him to conclude that Busch did indeed commit "an act of domestic violence" against Driscoll, but that is a separate matter from the police investigation into the incident that is now in the hands of the office of the attorney general. Busch, driver of the No. 41 car, was found to be in violation of: • Section 12.1.a: Actions detrimental to stock car racing • Section 12.8: Behavioral Penalty "Given the serious nature of the findings and conclusions made by the Commissioner of the Family Court of the State of Delaware, NASCAR has indefinitely suspended driver Kurt Busch, effective immediately. He will not be allowed to race nor participate in any NASCAR activities until further notice. "Kurt Busch and his Stewart-Haas Racing team are fully aware of our position and why this decision was made. We will continue to respect the process and timetable of the authorities involved." GM won't pay owners of recalled cars for lost value

Kenneth Feinberg, the man in charge of the General Motors compensation fund dealing with the its widespread ignition switch woes, has issued an informal, two-letter response to the plaintiffs in more than 70 lawsuits seeking redress for lost resale value of their Cobalts: "No." The cases were recently combined into one, but Feinberg told The Detroit News that the fund will deal "only with death and physical injury claims," and that "perceived diminished value" will get no consideration.
ALG, the firm specializing in establishing residual values, determined that Cobalt owners had lost $300 compared to the segment competition and doesn't envision any long-term effects from the recall situation. Feinberg's statement comes in advance of public details on how the compensation fund will work and adheres to GM's long-held position on the matter. The company has already asked a judge to throw out such suits using the pre-bankruptcy defense, even as it stopped using that defense in cases of injury and death.
With plenty of potential gain from the GM suit, however, don't expect the plaintiffs to give up yet. When Toyota was sued for the same reason during the unintended acceleration debacle, it eventually settled the case for between $1 billion and $1.4 billion just to get it over with. Since the 85 law firms involved in the Toyota litigation took home more than $250 million of that total, we shouldn't expect the attorneys to give up on a GM payout, either.

Recharge Wrap-up: Long Beach ePrix, London's new electric buses

London will put 51 new electric buses into service. With the addition of these buses, two more routes (in addition to one already in operation) will be all-electric. Transport for London plans to have all of central London's 300 single-decker buses running on electricity or hydrogen by 2020. "The expansion of London's electric bus fleet demonstrates our commitment to reducing emissions from public transport in London," says Deputy Mayor of London for Environment and Energy, Matthew Pencharz. "The Ultra Low Emission Zone that will be introduced in 2020 is the most ambitious measure of its kind taken to tackle air pollution anywhere in the world, and it will transform our bus fleet into a cleaner, greener and more pleasant way of travelling for Londoners." Along with 10 Cruze vehicles, one 2015 Volt has been recalled because of a tie rod that might not have been tightened to the steering gear correctly, which could lead to a loss of steering control. Chevrolet will replace the steering gear assembly, supplied by Robert Bosch Automotive Steering, for free. There have been no reported injuries from this issue. Read more at Detroit News. The Formula E Long Beach ePrix will take place on April 2, 2016. For the second season of the electric racing series, Long Beach is the only confirmed US host, as the spot on the calendar previously held by Miami still remains to be determined. More than 20,000 fans attended the inaugural Long Beach ePrix earlier this year, where Nelson Piquet, Jr. took first place before going on to win the Drivers' Championship. "It's extremely exciting to welcome the ePrix back to Long Beach for a second year," says Long Beach Mayor Robert Garcia, "and we are hopeful that this demonstration of innovation, sustainability, and cutting edge technology will return to our city year after year."
