GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Corvette Stingray Shooting Brake under consideration by Callaway [w/poll]

Callaway has released a few renderings of a design study for a shooting brake version of the C7 Chevrolet Corvette Stingray. The company says it wants to create a long-roof version of America's sports car to offer buyers more interior room and a vehicle with "unique style." The company says it will use structural carbon fiber for the new body bits, which suggests the conversion shouldn't add too much more weight to the Corvette. Along with a few mechanical tweaks, the Callaway Corvette Stingray AeroWagon could breeze past the 200 miles per hour barrier.
Provided that they get enough interest, Callaway estimates they will be able to effect the changes on the Chevrolet for around $15,000, and says the conversion work should be available through its network of dealers. GM's Oshawa plant may close after Camaro production moves

Most of the time, when vehicle production is moved from one assembly plant to another, it spells bad news for the former. While General Motors won't go so far as to say its Oshawa, Ontario factory, which is losing the Chevrolet Camaro to the Lansing Grand River plant, is in trouble, analysts seem to think the factory's days are numbered. Forecasts for the facility are far from positive. The loss of the Camaro this year, combined with GM's targeted shutdown of a single-shift assembly line responsible for the fleet-only Chevy Impala Limited and the Equinox crossover is a bad enough omen. But with AutoForecast Solutions CEO Joe McCabe telling The Detroit News that the plant's other two products, the Cadillac XTS and Buick Regal, aren't likely to stick around beyond 2017, things look decidedly grim at Oshawa. "There is a fairly strong chance that the plant could close," Jeff Schuster, senior VP of forecasting for LMC Automotive, told The Detroit News. That doesn't mean that Unifor, Canada's auto union, and the Canadian government are going to let the factory die without a fight. And with the latter chipping in $10 billion as part of GM's 2009 bailout, you might think it has a degree of leverage in the situation. A meeting between the government and the Detroit Three at the 2015 North American International Auto Show revealed that Oshawa is already a topic of conversation. "We made it very clear that we would like to see an indication on the future of Oshawa sooner, in particular because the timing is very challenging for our supply chain to be able to adjust to potentially future orders or changes, but also to know that there are going to be future opportunities at Oshawa," Ontario's Minister of Economic, Development, Employment and Infrastructure Brad Duguid told The Detroit News. "Bottom line: It's time they made a longer-term commitment here," Unifor President Jerry Dias said, echoing Duguid's statements. It's unclear if this sort of strong talk will be enough to save 3,300-plus employees, although based on the analysts' forecasts, we doubt it.
