GM does not have to turn over its ignition switch documents

In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.

US regulators issue a significant fine to Takata Corporation. And we take a peek inside tuner paradise at the 2015 SEMA show. The VW diesel emissions scandal, first brought to light in September, gets a new wrinkle, as an internal investigation by the German automaker revealed [00:00:30] irregularities in CO2 emissions that could affect approximately 800,000 vehicles. VW estimates the issue could pose a 2-billion euro economic risk. VW claims that most of the vehicles affected have diesel engines, but industry analysts say a 1.4-liter gas engine is also affected. VW says that fuel consumption figures were set too low during the CO2 certification process. During all of this, sales of some diesel-powered Volkswagen, Audi, and Porsche models [00:01:00] have been halted. Takata Corporation is back in the news in connection with its deadly airbag scandal. Federal regulators fined Takata $70 million. If the parts supplier does not comply, the fine could balloon to $200 million. Takata was also dropped this week by its biggest customer, Honda. And now, Toyota and Mazda will be following Honda's lead in dropping Takata. We're also hearing that Mitsubishi and Subaru are considering a switch in air-bag inflator suppliers. SEMA 2015 [00:01:30] came and went. We saw offerings from Mopar, like the AWD Challenger concept. Honda unveiled a Ridgeline that it will race at the Baja 1000, which gives us a hint at what future production model could look like. The celebrity presence was also felt in Vegas as it always is. Kid Rock brought a Duramax Diesel Chevy Silverado, and Acura restored and presented Ludacris with his now famous 1993 Acura Legend. Those are the highlights from the week that was. GM veteran Bryan Nesbitt tapped to head Buick design

General Motors styling veteran Bryan Nesbitt (pictured above) took over a new role on Monday as executive director of global Buick design and global architectures. Andrew Smith, who previously did that job and also coordinated the look for Cadillac, has remained in charge of the pen at Caddy with this shift. Nesbitt rose to prominence when he designed the Chrysler PT Cruiser, according to Automotive News. He joined GM in 2001 and has been there ever since in multiple high-level roles. In 2007, he was appointed vice president of design for North America and was later briefly general manager of Cadillac in 2009-2010. Nesbitt took over as the vice president of GM's international operations design in China in 2011. This shuffle also moves Ken Parkinson, currently styling boss for Chevrolet trucks, to China as design vice president there. In addition, John Cafaro becomes the person in charge of the look for Chevy globally, rather than previously splitting that role between cars and trucks with Parkinson. GM Global Design Leadership Changes – effective June 1, 2015. Bryan Nesbitt, Design Vice President, GM China will repatriate to North America and assume the position of Executive Director, Global Buick and Global Architectures. He will be located in Warren, MI. Bryan will be the design Champion for Buick in the US and China. Ken Parkinson, Executive Director, Global Chevrolet Trucks and Global Architecture will assume the position of Design Vice President, GM China. He will be based in Shanghai, China. Andrew Smith, Executive Director, Global Cadillac and Buick Design will assume the position of Executive Director, Global Cadillac. He will continue to be the design Champion for the Cadillac brand. In addition, he will continue to lead the Global Color & Trim team. He will be based in Warren, Michigan. John Cafaro, Executive Director, Global Chevrolet Cars will assume the position of Executive Director, Global Chevrolet. He will be the design Champion for Chevrolet. In addition, John will lead the exterior components and accessories team. He will continue to be based in Warren, MI. The roles and responsibilities of Helen Emsley, Mark Adams, Carlos Barba, Clay Dean, Michael Simcoe, and Teckla Rhoades remain the same.
