GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Automakers score 8 out of top 20 most-watched ads on YouTube [w/videos]

Who would have ever thought there'd be a day where people are able to skip television commercials only to go to websites to watch them later? Such is the joy of a DVR and YouTube. AdWeek tabulated the 20 most-watched ads on YouTube, and found that nine were car-related including eight coming from automakers.
Volkswagen continued its Star Wars theme with two ads in the top 20, including the highest-ranking car commercial The Bark Side spot at number three with almost 18 million views, which doesn't even have a single car in it. Some of our favorites are from Chrysler with Clint Eastwood in It's Halftime in America and House Arrest with Charlie Sheen for the Fiat 500 Abarth. Chevrolet, Honda, Audi and Toyota were the other automakers in the top 20, but we'd be remiss if we didn't at least mention one of the coolest ads on the list, the Hot Wheels corkscrew jump.
Of all the car videos, only the Fiat ad wasn't played during a Super Bowl. Check out all eight videos - in order - after the jump. Nike took the top spot with its My Time is Now ad that has been seen online more than 20 million times with Pepsi's Uncle Drew posted up in the runner-up; some of the other videos include four Old Spice commercials and an ad in which Snoop Dogg is pedaling Hot Pockets.

2021 Cadillac Escalade, GMC Yukon, Chevy Suburban/Tahoe recalled for stall risk

General Motors is recalling just shy of 15,000 2021 Cadillac Escalade & Escalade ESVs, Chevrolet Suburbans and Tahoes, GMC Yukons and Yukon XLs that were shipped with fuel pumps that were built with a batch of what may be faulty electronic control modules. A pump with a bad module can result in intermittent function, resulting in drivability issues and potential stalls. No serious incidents or injuries have been associated with the issue.  GM says it discovered the issue after analyzing early recall data for the 2021 model SUVs and discovering an unusually high failure rate for fuel pumps manufactured by a single supplier – Vitesco. The company was able to identify the batch and initiate a recall campaign targeting just those vehicles.  "After reviewing the field data, GM determined there were 617 potentially relevant complaints, which were received between April 15, 2020 and August 24, 2021," the company's recall report said. "229 of these complaints reported a stall while standing or moving. No accidents or injuries associated with this condition were found." Any SUVs built with pumps from that batch but not yet sold are being held at dealers for replacement parts. It may take some time for GM to source replacements due to the ongoing electronic parts shortages.  "We are working with the supplier to obtain the required parts as quickly as possible," GM said in its notice to dealers. "When sufficient quantity of parts are available, the recall bulletin will be released and dealers can begin repairing vehicles."
