GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Comedians in Cars Getting Coffee teases return with a Countach

Unless you have an intense aversion to Jerry Seinfeld, it's hard not to find something to like about his show Comedians in Cars Getting Coffee. After all, the series combines funny people telling often hilarious stories while riding in ridiculously cool vehicles. The trailer for the sixth season is now online, and based on this tease, this definitely looks worth watching no matter what part of the videos interest you. Of course, it's the automotive portion that really grabs us, and Seinfeld has quite a fleet to showcase for season six. The trailer shows off a Lamborghini Countach, a '57 Chevrolet Bel Air convertible, a classic Volkswagen Beetle in the green and white German Polizei livery, a Morgan, an Aston Martin DB5, and a Ferrari 308. On the more humorous side of things, the guest list at least includes Julia Louis-Dreyfus, Jim Carrey, Steve Harvey, Stephen Colbert, Bill Maher and upcoming host of The Daily Show Trevor Noah. 2016 Chevy Volt will start at $33,995*

One of the biggest mysteries regarding the 2016 Chevy Volt has been revealed. Chevy announced today that the next-gen plug-in hybrid will have an MSRP of $33,995, which includes GM's $825 destination fee. That's a few hundred dollars less than the current Volt, which has an MSRP of $34,170. The second-gen Volt is about more than a price cut, though. The car has an increased all-electric range (50 miles vs. 38 in the current model) and better fuel economy. Once the battery power runs out – which it doesn't do, in most situations, since 90 percent of all trips are electric-only – the no-longer-premium-only gas engine offers 41 miles per gallon, up from 37 mpg. We know most buyers are price-conscious, and with the still-available federal tax incentive of up to $7,500, the new Volt can be had for $26,495. That should put a spring back into sluggish Volt sales, which are down 46 percent year-over-year so far in 2015. Through the end of April, GM has sold a cumulative 76,136 first-gen Volts since introducing the car in 2010. The Volt continues to be a success with the brand with nearly 70 percent of Volt owners trading in a non-GM product or adding to their household fleet in 2014, the highest of any Chevy nameplate. The number one trade-in for the Volt is the Toyota Prius. To date more than 75,000 first generation Volt owners have driven hundreds of millions of EV miles.
