GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. How long will the 'golden age' of performance last?

High-powered sports and luxury cars were everywhere at the New York Auto Show, prompting the obvious question for enthusiasts: How long will this golden age of performance last? Industry leaders have some time before regulations elevate the Corporate Average Fuel Economy level in 2025. Even then, they expect cars rippling with power to survive in some form. "Is it the end of an era," I don't think so," said Ola Kallenius, Daimler AG board member for Mercedes-Benz cars marketing and sales. "That performance element of individual mobility I don't think will ever go away." Kallenius, who oversaw the company's AMG division from 2010-2013, expects it to continue to grow. Last year, AMG sold a record 68,875 units around the world, an increase of 44.6 percent over 2014, with strong growth in the US, China, and Germany. Still, there's always the potential for gas to spike, and pending fuel economy regulations are looming. That could lead AMG to add electrification to its products, Kallenius said, pointing to the electric SLS as a test case. Chevy is also thinking ahead, said Al Oppenheiser, chief engineer of the Camaro. He wouldn't bite when asked about electrification for the Camaro (he did say "never say never"), but admitted in 2025 "it's going to be pretty tough to sell V8s." For now, things are rosy for muscle cars, and Chevy confidently showcased the 640-hp Camaro ZL1 in coupe and convertible form in New York. "I think that this is truly the golden age of performance," Oppenheiser said. It's hard to disagree. News & Analysis News: The 2017 Mazda MX-5 Miata RF was a show-stopper in New York. Even as a parade of SUVs and flashy luxury cars rolled out the rest of the week, the Miata remained a hot topic. The Retractable Fastback is really a clever targa top, with part of the roof stowing behind the seats, adding about 100 pounds compared to the standard convertible. It makes the car more practical and arguably more attractive. The RF continues Mazda's tradition of selling the Miata with a hardtop variant. The first and second generations offered a detachable one, and a power retractable hardtop (a $1,700 option) was available on third-gen models. Judging by its reception in New York, the RF could prove to be even more popular than its predecessors.

Vert-A-Pac train cars kept your Chevy Vega's price in check

Our apologies to those who've seen this before, but for the rest of the class, how awesome are these pictures of the Vert-A-Pac shipping system General Motors came up with to ship the Chevrolet Vega back in the 1970s? Developed along with Southern Pacific Railroad, GM was able to double the amount of Vega models it could ship by packing them into the unique storage cars vertically.
At the time, rail cars could fit 15 vehicles each, but Chevrolet was able to lower shipping costs by making it possible to ship 30 Vegas per rail car, in turn allowing the price of the Vega to remain as low as possible. Each rail car had 30 doors that would fold down so that a Vega could be strapped on, and then a forklift would come along and lift the door into place. All the cars were positioned nose down, and since they were shipped with all of their required fluids, certain aspects had to be designed specifically for this type of shipping, including an oil baffle in the engine, a special battery and even a repositioned windshield washer reservoir.
