GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2014 Chevrolet Cruze TD fires up its new diesel motor

Ever since General Motors confirmed plans to produce a diesel-powered Cruze back in 2011, we've been eagerly awaiting its arrival. And as part of the 2013 Chicago Auto Show, Chevrolet has pulled back the cover on its oil-burning compact sedan, set to go on sale in the near future with a starting price of $25,695, not including $810 for destination.
The heart and soul of the Cruze TD (that's its official name) is a 2.0-liter turbo-diesel inline four-cylinder engine rated at 148 horsepower and 258 pound-feet of torque, mated solely to a six-speed automatic transmission. The engine also has an overboost function that will increase torque to 280 lb-ft for up to ten seconds. The full brace of official specs haven't been released, but GM tells us that highway fuel economy will come in at 42 miles per gallon. If that number sounds familiar, it's because the Volkswagen Jetta TDI has the exact same rating. Unlike the Jetta, however, the Cruze TD can run on B20 biodiesel, where as the Volkswagen can only accept B5.
Model-specific changes to this 2014 Cruze TD include an aero kit and unique 17-inch alloy wheels. Inside, there's a full leather interior, and Chevrolet will provide two years of complimentary scheduled maintenance, not to mention a 100,000-mile powertrain warranty.

Chevy Silverado Midnight Edition coming to Chicago

Between the GMC Canyon Nightfall Edition and Chevy Silverado Custom Sport, the truck divisions of General Motors had no lack of blacked-out custom pickups to showcase at the Detroit Auto Show this year. But now the General has announced one more. Called the Midnight Edition, for this special Silverado blacks out all the trim, including the grille, bumpers, headlamp bezels, tow hooks, fog lamps, side and beltline moldings, 19-inch wheels, bedliner and bowtie emblems. It's based on the Silverado 1500 with the Z71 package, so it also boasts an off-road suspension, locking rear differential, hill-descent control and trailering pack. While it was at it, Chevy has also thrown in rear park assist and power heated door mirrors. Buyers will be able to choose between double- or crew-cab models, but no more than 5,000 examples will be produced this year, each priced at a premium pegged between $1,595 and $1,995 (depending on the model).
