GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2014 Chevy Cruze Diesel destined for Chicago debut

It's been a little over a year and a half since General Motors first confirmed plans to offer a diesel-powered Chevrolet Cruze here in the United States, and we've now learned that the oil-burning compact will debut under the lights of the Chicago Auto Show in February. According to GM Authority, the Cruze Eco-D will be introduced as part of the entire 2014 model year Cruze range, set to go on sale in the second quarter of this year.
Earlier reports have indicated that the diesel Cruze will be able to achieve fuel economy numbers in the range of 50 miles per gallon. For comparison, the similarly sized Volkswagen Jetta TDI is rated at 30/42 mpg city/highway, but as we found out in our long-term test of the 2011 model, hitting 50 mpg was a piece of cake.
Official specifications will be released at the time of the 2014 Cruze's unveiling, though reports have stated that the sedan will be powered by a reworked version of the 2.0-liter turbo-diesel inline-four found in the Holden Cruze CDX overseas. In that application, the four-pot oil-burner produces 160 horsepower and 265 pound-feet of torque - increases of 20 hp and 29 lb-ft over the 2.0-liter engine used in VW's Jetta TDI.

Man spent $75 on a truck that lasted 38 years

Absurd as it is, some buyers today are worried about getting their car to last throughout the term of their seven-year car loan. Minnesota resident Bob Sportel has the opposite issue: his Chevrolet truck seemingly won't die. Sportel needed a cheap ride to get to work when he took a job at a farmer's co-op 38 years ago, so he bought a rusty 1957 Chevy pickup for $75 from a farmer; at the time, the 20-year-old truck was almost as old as Bob was. After nearly four decades of daily driving and an estimated 300,000 miles, Sportel is still driving the truck today. Bolts secure a fender, Bondo secures the lights, what looks like a whole roll of duct tape keeps him sitting on the bench seat instead of in it. For a 58-year-old pickup that's never seen a garage or a new coat of paint – but did get its oil changed four times a year – that's not bad; Sportel thinks his repair bill hasn't got above $1,000 for the entire time he's owned the truck.
