GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GMC Envoy could be returning as GM files for 'Envoy' trademark

The GMC Envoy could be on its way back, if a recent GM trademark filing is any indication of the future. To be exact, GM's trademark filing is for the name "Envoy," and is applicable to "motor vehicles, namely, sport utility vehicles, engines therefor and structural parts thereof." A victim of the recession and high gas prices, the original Envoy – related to the Blazer, and more recently the TrailBlazer and similar GM SUVs – was discontinued after the 2009 model year. In today's SUV-happy market of low gas prices, unearthing the somewhat familiar Envoy name makes a certain amount of sense. As soon as gas prices start trending in the other direction, we'll all be saying the opposite, though. What this SUV will take shape as is the big question now. With the Chevrolet Blazer well and truly on its way, there's every reason for a GMC version of Chevy's stylish new crossover sporting the Envoy name. Another, less likely, possibility is a Traverse-sized vehicle to slot between the shorter Acadia (10 inches shorter than the Chevy Traverse) and the body-on-frame Yukon. GM could come out of left field and make the Envoy a Buick too. It fits the bill with the "En" beginning, and Buick undoubtedly has crossovers in the works. We think that's even more unlikely, but it's important to remember that we're still in the speculation phase. Soon we'll drive Chevy's new Blazer, and perhaps have more news then. Callaway, Lingenfelter boost Corvette Z06 way beyond 700 hp

With 650 horsepower and just as much torque on tap, few would accuse the latest Corvette Z06 of being down on power. But for those who'll always demand more, two leading Corvette tuners have just announced new tuning packages for the Z06 to boost Chevy's flagship well beyond 700 horsepower. The more powerful of the two comes from Callaway Cars, which has added a larger supercharger, a triple-action intercooler, and more to increase output to a massive 757 horsepower and 777 pound-feet of torque. The result, according to Callaway, is a 0-60 time quoted at 2.8 seconds and a quarter-mile run in 10.5. The package also includes a reshaped hood, all manner of trim upgrades, and a three-year warranty, and will set you back nearly $17k on top of the cost of donor vehicle that currently lists for $79,000. In what could only come second relative to Callaway's kit, Lingenfelter Performance Engineering has also released a Stage 1 package for the Z06. The kit includes a new dry sump damper, upgraded supercharger pulley and drive belt, and more – all of which Lingenfelter says will boost the Vette's output up to 720 hp and 730 lb-ft. Revised performance figures weren't released, but despite the 37-horse, 47 lb-ft deficit, we doubt it'd trail Callaway's by much. But both would likely leave the stock Z06 in their dust, and you can read more about them in the press releases below. A launch to 60 mph is now achieved in 2.8 seconds, and a quarter-mile in 10.5 seconds at 131 mph. Why Go Big, When You Can Go Bigger? - Size Matters. To reach that power (which is up from 650 bhp / 650 lb-ft) the supercharger itself needed to be bigger since the output of a positive displacement supercharger is proportionate to its size. The Callaway GenThree supercharger is 32% larger in displacement (2300cc vs 1740cc). Cooling - Callaway engineers recognize that a key contributor to maximizing power is reduction of inlet air temperature associated with forced induction.
