Did BMW drag its feet on Mini recall?

The National Highway Traffic Safety Administration is opening an investigation into BMW's reporting of a recall for 30,456 examples of the 2014-2015 Mini Cooper Hardtop, Cooper S, and the 2015 John Cooper Works. According to the government, "it appears from a review of NHTSA's databases that BMW may have failed to submit recall communications to NHTSA in a timely manner." The automaker issued the recall in July because crash tests showed the models didn't meet side impact requirements for passengers in the back seat. While there were no reported injuries at the time, the company decided to install energy-absorbing material in the space between the rear interior panels and the exterior. However, NHTSA has decided to investigate whether this campaign should have started much earlier, given the evidence the company had. According to the government's report, the Cooper Hardtop failed side-impact tests in 2014, although one of these tests was five-miles-per-hour faster than the Federal Motor Vehicle Safety Standard. The agency claims: "In January 2015 BMW verbally committed that it would conduct a service campaign to add padding to the rear side panels of MY 2015 Mini 2 Door Hardtop Cooper models. However, BMW did not initiate the service campaign and failed to inform NHTSA of its failure to do so." A subsequent crash test of an example with this fix showed it to make the vehicle compliant with the rules. Mini spokesperson Mariella Kapsaskis told Autoblog: "Regarding the NHTSA audit query, BMW Group is evaluating the request and will respond to NHTSA as appropriate." Under the hood, BMW M GmbH upped the output from the 3.0-liter twin-turbo inline-six from 425 horsepower to 444 – neatly bridging the gap to the 493-hp M4 GTS, and not limited to just the coupe. The power boost nets an improvement in the 0-60 time of 0.1 seconds, so if you apply it to an M3 sedan or M4 coupe with the 7-speed DCT, you'll be rocketing to 60 in just 3.8 seconds. At the other end of the spectrum, an M4 convertible with the comp pack and the manual gearbox takes 4.1 seconds for the same sprint. The M division also fitted an active suspension and diff, 20-inch forged alloys, and staggered tires. Vehicles fitted with the package can be visually distinguished by their black chrome tailpipes and glossy black trim. Fixed-roof examples also benefit from new seats, which the convertible has to forgo. So while it'll cost $5,500 to fit the Competition Package to a sedan or coupe, the cost for the convertible falls to a nice, round $5,000. Part of the joy of the SEMA Show is that all of the best tuners in the world are competing to show off their wares, and the challenge often pushes the companies into some absolutely insane directions. Case in point: Vorsteiner and its ludicrous GTRS4 wide body kit with the BMW M4.
According to Auto Evolution, the kit reportedly adds 4 inches in the front to fit 10.5-inch-wide wheels and a massive 7-inches more in the rear to snug in 13.5-inch-wide wheels, but spinning around the BMW in these images makes the changes look even more extreme. Beyond just the extra room in the fenders, the lower air intakes are ready to suck in huge volumes of cool air, and there's a front splitter to keep things planted. The front and rear extensions are joined by side sills that grow the farther back they go. Finally, at the rear, the M4 gets a reworked diffuser with mesh inserts.
