NHTSA slaps BMW with $40M fine for slow Mini recall

BMW is on the hook for a $40-million fine after the National Highway Traffic Safety Administration slapped the automaker over not recalling Minis that failed to meet minimum side-impact crash standards. The civil penalty from NHTSA concerns 2014 and 2015 Mini Cooper hatchback models that "failed a crash test designed to determine whether the vehicle met crash-protection minimums," the government agency said in a press release issued this week. An October 2014 test revealed the first problem, and the Mini was subsequently retested in July, only to fail again and finally prompt a recall of more than 30,000 cars. But according to NHTSA's investigation that was opened in October, BMW waited too long to issue a recall after it knew the cars did not meet standards and bring them into compliance with more energy-absorbing materials installed by Mini dealers. This is the second time NHTSA slapped BMW with a major penalty, following a $3-million fine back in 2012 failing to report recalls of its cars and motorcycles. "For the second time in three years, BMW has been penalized for failing to meet that obligation," NHTSA Administrator Mark Rosekind said in the release. "The company must take this opportunity to reform its procedures and its culture to put safety where it belongs: at the top of its priority list." In a separate release issued this week, BMW Group said it, "is committed to further improving its recall processes to better serve its customers," and that the company, "respects the role of NHTSA and looks forward to working with them to develop solutions for the future." BMW CEO faints on stage at Frankfurt press conference

Newly minted BMW AG CEO Harald Kruger has had a rough start to his first Frankfurt Motor Show in that position. Kruger fainted about five minutes into the BMW press conference. A pair of assistants helped the executive to his feet and off-stage, and, understandably, the presser was cancelled. A report in Financial Times indicates that Kruger was not feeling well leading up to his appearance at the show, and that the fainting spell was a result of "a moment of dizziness." Kruger was taken to an area hospital where he is said to be recovering from the incident, and in stable condition. The life of the top dog at a major automaker has got to be stress-filled, sleep-deprived, and hard to handle under normal circumstances, let alone before a major exhibition like Frankfurt. We wish Kruger a speedy recovery getting back to it. And we're certain that he'll face a busy schedule, once again, when he's back on his feet. The CEO replaced Norbert Reithhofer in May of this year, and now oversees a BMW with as big a model lineup as the brand has known, including the recently launched new 7 Series. Did BMW drag its feet on Mini recall?

The National Highway Traffic Safety Administration is opening an investigation into BMW's reporting of a recall for 30,456 examples of the 2014-2015 Mini Cooper Hardtop, Cooper S, and the 2015 John Cooper Works. According to the government, "it appears from a review of NHTSA's databases that BMW may have failed to submit recall communications to NHTSA in a timely manner." The automaker issued the recall in July because crash tests showed the models didn't meet side impact requirements for passengers in the back seat. While there were no reported injuries at the time, the company decided to install energy-absorbing material in the space between the rear interior panels and the exterior. However, NHTSA has decided to investigate whether this campaign should have started much earlier, given the evidence the company had. According to the government's report, the Cooper Hardtop failed side-impact tests in 2014, although one of these tests was five-miles-per-hour faster than the Federal Motor Vehicle Safety Standard. The agency claims: "In January 2015 BMW verbally committed that it would conduct a service campaign to add padding to the rear side panels of MY 2015 Mini 2 Door Hardtop Cooper models. However, BMW did not initiate the service campaign and failed to inform NHTSA of its failure to do so." A subsequent crash test of an example with this fix showed it to make the vehicle compliant with the rules. Mini spokesperson Mariella Kapsaskis told Autoblog: "Regarding the NHTSA audit query, BMW Group is evaluating the request and will respond to NHTSA as appropriate."
