BMW to pay $1.6M, rehire workers in discrimination settlement

A BMW subsidiary is on the hook for $1.6 million and must rehire workers as part of a settlement for a race discrimination lawsuit with the US Equal Employment Opportunity Commission. A change in BMW Manufacturing's criminal background check policy at the Spartanburg, SC, factory disproportionately affected African American workers, according to the EEOC, and it cost many people their jobs. The automaker has since changed the policy. According to Automotive News, the suit stemmed from BMW switching logistics contractors at the plant in 2008. As a result, 645 existing workers had to submit revised criminal background checks to keep their jobs. About 100 people didn't meet the new guidelines, according to the EEOC, and they lost their jobs. Around 80 percent of those affected were African American. According to the government agency's complaint, the altered procedures only took into account the category of a crime, not factors like when it occurred or whether the infraction was a misdemeanor or felony. With the settlement accepted by US District Court, BMW must offer work to the affected employees in this case and as many as 90 African American applicants that the contractor didn't hire because of the rules. The automaker also must offer training in the proper manner for criminal background checks. While there's nothing inherently wrong with investigating workers, "when a criminal background screen results in the disproportionate exclusion of African-Americans from job opportunities, the employer must evaluate whether the policy is job related and consistent with a business necessity," P. David Lopez, the EEOC's General Counsel, said in the agency's release, which you can read below. BMW spotted testing new 5 Series Gran Turismo

As previously reported, BMW is going ahead with a second-generation 5 Series Gran Turismo, no matter how silly the first generation of the sedan-cum-hatchback-cum-wagon may be. These are our first spy photos of that new vehicle, which is still on track for a late 2016 debut. Perhaps the best thing we can say about the next 5GT is that it won't be quite so hunchbacked. The seven images provided by our spy photographer show a car with a profile that's far more svelte than the bulbous entry on offer today. The roofline, in particular, is more aggressively raked at the rear and there's a proper, distinguished rear deck, as well. Part of what makes today's 5 Series GT look so bizarre is the combination of an almost fastback tail with a very tall decklid height. While the updated model still features that high rear – you can actually see where the beltline kicks up at the rear quarter window – the fastback styling has been softened so that it doesn't look quite so bizarre. The new Gran Turismo should also be a much better steer than the 5GT currently on offer. Our spies report that this next-gen model will be significantly lighter, which is something we can always get behind. Engine options will consist of gas, diesel, hybrid, and plug-in hybrid, as is the trend, although specifics aren't quite available yet. Spitballing, though, it's almost a guarantee that the next 5GT will share the 5 Series sedan's engine lineup. Expect a number of carryover engines there – 2.0-liter turbo four, 3.0-liter turbo six, 4.4-liter twin-turbo V8, and 3.0-liter diesel, probably – along with a plug-in hybrid option, although nothing's been confirmed so far. With an official debut slated for late next year, either Paris or Los Angeles seem like a logical debut location.

Consumer Reports selling its road-tested roadsters [w/video]

Here's a chance to acquire a celebrity-owned vehicles, and this time at a discount instead of a premium. So the celebrity in this case is Consumer Reports, that magazine that could be equally adored and abhored by car enthusiasts. CR buys all of its test vehicles and usually finds willing second owners within its own ranks, but its opening its small used-car lot to the public. On the forecourt are four roadsters: an automatic 2012 Audi TT 2.0 TFSI Quattro S-Tronic with 6,600 miles for $36,500, a manual 2012 BMW Z4 sDrive28i with 8,400 miles for $45,000, a manual 2012 Mercedes-Benz SLK250 for $39,500 and a manual 2013 Porsche Boxster with 7,000 miles for $48,000.
Those numbers mean a savings of $9,000 to $10,000 before haggling - each car is listed with an "Asking price" so there could be some wiggle room if you show up with pockets full of dough and eyes full of serious intent. Since the money CR earns from the sales go back into the magazine's budget to buy more test cars, however, it probably won't take any oddball trades, so you can forget about getting any purchasing help from that track-day AMC Javelin project on blocks in the back yard.
The vehicles have been taken care of and spiffed up for sale; buyers will take delivery at the CR test track in East Haddam, Connecticut and get a tour of the facilities. While you're there they'll even take you on a lap around the track so you can feel how your car handles when driven by one of its testers. They will probably not help you with advice on which toaster and dehumidifier to buy - you'll still need to get a subscription for that.
