US prepares to sue Fiat Chrysler over diesel emissions testing

NEW YORK - The Justice Department plans to file a civil lawsuit against Fiat Chrysler Automobiles NV over excess diesel emissions as early as this week if no agreement is reached with the Italian-American automaker, two sources briefed on the matter said on Wednesday. The Environmental Protection Agency in January accused FCA of illegally using undisclosed software to allow excess diesel emissions in about 104,000 cars and SUVs, the result of a probe that stemmed from regulators' investigation of rival Volkswagen AG. The EPA and California Air Resources Board have been in talks with FCA about the excess emissions and whether the agencies would approve the sale of 2017 FCA diesel models. A federal judge in California has set a May 24 hearing on a series of lawsuits filed by owners of vehicles against Fiat Chrysler and the Justice Department is expected to file its action by then if no agreement is reached. FCA said on Wednesday it believed that any litigation would be "counterproductive" to ongoing discussions with the EPA and California Air Resources Board. The company added that "in the case of any litigation, FCA US will defend itself vigorously, particularly against any claims that the company deliberately installed defeat devices to cheat U.S. emissions tests." The Justice Department took the same procedural step in early 2016 against Volkswagen, nearly four months after the German company admitted using software to emit excess diesel emissions in nearly 500,000 vehicles. The Justice Department has had an ongoing criminal investigation into FCA's conduct since last year, Reuters reported in January. The probe has turned up internal emails written in Italian and other documents about engine development and emissions issues, sources briefed on the probe said. U.S. regulators said FCA failed to disclose engine management software in 104,000 U.S. 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3.0-liter diesel engines. The European Commission has launched legal action against Italy for failing to respond to allegations of emission-test cheating by Fiat Chrysler in a procedure that could lead to the country being taken to court. The EPA has said the maximum possible fine against FCA could be $4.6 billion. In February, FCA said it had received requests for information and subpoenas from U.S. federal and state authorities, including the Securities and Exchange Commission, for diesel issues.

Honda, Mazda, Mitsubishi, Mercedes also under diesel emissions scrutiny

The controversy over Volkswagen's diesel emissions scandal isn't limited to the US. In Europe, where diesel engines are far more popular, the issue is shining a harsh light on the NEDC emissions test. As already known, the evaluation does a poor job of reflecting real-world production of NOx, and it appears a significant number of automakers are affected. The Guardian in the UK has been reporting on real-world test results from a company called Emissions Analytics. After the latest round of checks, vehicles from Mercedes-Benz, Honda, Mazda and Mitsubishi were found to generate far more NOx than they should. The newspaper also published similar results for Renault, Nissan, Hyundai, Fiat, Volvo, Jeep, Citroen, VW, and Audi. On average, the figures are about four times over the limit of producing the pollutant. Unlike VW and its defeat device, these automakers aren't actually breaking the rules. The vehicles perform up to the NEDC lab test for emissions, but those results simply aren't translated to the street. "The VW issue in the US was purely the trigger which threw light on a slightly different problem in the EU - widespread legal over-emissions," Nick Molden from Emissions Analytics said to The Guardian. A big fight to decide the future of this issue appears to be on the horizon. Automakers claim that they can't meet the next round of tightening emissions regulations and are asking for compromises. Although, spokespeople for Mercedes and Honda told The Guardian that the brands would be in favor of the stricter rules. Meanwhile, some European governments began backtracking their support of diesels well before this scandal came to light. The added scrutiny certain hasn't helped the future of the oil-burner. Wasn't that riveting? The blue paint sure is bright, eh? Well, now you must be wondering how that new 2019 Corolla stacks up with all the other hatchbacks. And, despite long thinking that hatchbacks were doomed, there are actually quite a lot of them these days. So many, in fact, that we couldn't fit them all in our space-limited comparison chart. So, with apologies to the Hyundai Elantra GT, Kia Forte and the dead-man-walking Ford Focus, these were the cars we chose based on sales and competitiveness: the Honda Civic Hatchback, Mazda3 5-Door, Volkswagen Golf, Chevrolet Cruze and Subaru Impreza. Performance and fuel economy There is but one king here, and its name is Civic. While the sedan and coupe come with a naturally aspirated 2.0-liter 158-horsepower four-cylinder that's less potent than the Corolla's, the hatchback comes standard with the 1.5-liter turbo that aces the segment in terms of both acceleration and fuel economy. The Golf's acceleration should be comparable, but as you can see, it trails on fuel economy (still not bad, though). The new Corolla ends up being better than the rest with its new 168-hp four-cylinder paired to novel transmissions: a six-speed manual with rev-matched downshifting (!) and a CVT that mimics the actions of a 10-speed automatic. The Corolla does weigh more than everything else, though, so that could hamper its acceleration. Fuel economy data also wasn't announced, but Toyota indicated it would be a bit better than the old Corolla iM. Something akin to the 2.0-liter Mazda 3's numbers seems likely. As for the Mazda, its top two trim levels actually come standard with its bigger engine. In any event, despite its ample power, testing has often showed that the Civic is still the quicker car from 0 to 60 mph. And finally, let's not leave out the two on the end. The Subaru is the only car in the segment that offers all-wheel drive (the Focus RS and Golf R don't count), but is also the segment weakling now that the Corolla iM has been discontinued.
