German authorities investigate Winterkorn

Former Volkswagen CEO Martin Winterkorn is potentially walking away from the embattled automaker with a $32-million pension, but his retirement might not be quite so relaxed because German prosecutors in the city of Braunschweig (also called Brunswick) are now investigating his role in VW's diesel emissions evasion. The lawyers want to know whether he committed fraud, and a conviction could mean up to 10 years in prison, according to the Associated Press. However, this process is still in its earliest stages, and Winterkorn is long way from sitting in a courtroom. With other high-profile corporate cases in Germany as a guide, a trial could be years away. Lawyers haven't even questioned the former CEO, yet. In Germany, people are free to file criminal complaints, and prosecutors then decide whether a full investigation is necessary. According to the AP, Braunschweig has received about 12 grievances so far, including one from Volkswagen. The law in the country also doesn't allow charging businesses with wrongdoing, only people. Winterkorn resigned from his role at the top of VW last week, just a day after issuing a video apology for the automaker's actions. Former Porsche boss Matthias Muller has succeeded him. Along with having a new person in charge, the automaker's Supervisory Board instituted a thorough corporate reshuffle to put more focus on various regions and give brands additional power by early next year. TN politicians may push to end VW incentives if plant goes union

Volkswagen's Chattanooga Assembly Plant is scheduled to vote on whether to unionize in the coming days, but Tennessee state lawmakers are threatening to deny future tax subsidies to the factory, if the vote is successful. The factory is currently the only Volkswagen plant worldwide that is not unionized.
The states's Republican lawmakers have been particularly vocal against the union vote. Tennessee state senator Bo Watson said during a press conference that VW would have a "very tough time" with future incentives if the vote were successful, according to Automotive News. Tennessee House Majority Leader Gerald McCormick said the "heavy hand" of the UAW is not welcome there. VW has drawn criticism from both sides because it has allowed both pro- and anti-union groups to speak to workers and hand out leaflets.
Roughly 1,500 factory employees will vote on whether to unionize from February 12-14. If successful, the Chattanooga factory would be the first in the US organized under a German-style works council system where white- and blue-collar workers directly negotiate factory issues with the company's management.

Recall on VW diesels begins in January, Mueller claims

A recall on Volkswagen's diesel vehicles with cheating software has been inevitable since the scandal first came to light, but there has been little official word on a timeframe for the fix. The automaker's new CEO Matthias Muller has finally put a tentative date on repairs, though. "If all goes according to plan, we can start the recall in January. All the cars should be fixed by the end of 2016," Muller said to the Frankfurter Allgemeine Zeitung, Reuters reports. While this plan affects Europe, the timing for repairs in the US could be slightly different. The Environmental Protection Agency needs to test the fix first here to make sure that it brings the vehicles in line with emissions regulations. Before the scandal came to light publicly, VW already tried a software update, but the California Air Resources Board still found NOx levels to be too high. Some experts have speculated that whatever the automaker comes up with this time could affect performance and fuel economy. To make lemonade out of these very sour lemons, Muller is trying to position the scandal as a chance to change. "This crisis gives us an opportunity to overhaul Volkswagen's structures," the CEO said, according to Reuters. "We want to make the company slimmer, more decentralized and give the brands more responsibility." Still, the effects are definitely being felt inside the automaker. When addressing employees recently, Muller admitted the necessity of cutbacks and the likelihood of setting aside even more money to pay for international fines and settlements. "What isn't absolutely vital will be canceled or delayed," he said. Related Video:
