US prepares to sue Fiat Chrysler over diesel emissions testing

NEW YORK - The Justice Department plans to file a civil lawsuit against Fiat Chrysler Automobiles NV over excess diesel emissions as early as this week if no agreement is reached with the Italian-American automaker, two sources briefed on the matter said on Wednesday. The Environmental Protection Agency in January accused FCA of illegally using undisclosed software to allow excess diesel emissions in about 104,000 cars and SUVs, the result of a probe that stemmed from regulators' investigation of rival Volkswagen AG. The EPA and California Air Resources Board have been in talks with FCA about the excess emissions and whether the agencies would approve the sale of 2017 FCA diesel models. A federal judge in California has set a May 24 hearing on a series of lawsuits filed by owners of vehicles against Fiat Chrysler and the Justice Department is expected to file its action by then if no agreement is reached. FCA said on Wednesday it believed that any litigation would be "counterproductive" to ongoing discussions with the EPA and California Air Resources Board. The company added that "in the case of any litigation, FCA US will defend itself vigorously, particularly against any claims that the company deliberately installed defeat devices to cheat U.S. emissions tests." The Justice Department took the same procedural step in early 2016 against Volkswagen, nearly four months after the German company admitted using software to emit excess diesel emissions in nearly 500,000 vehicles. The Justice Department has had an ongoing criminal investigation into FCA's conduct since last year, Reuters reported in January. The probe has turned up internal emails written in Italian and other documents about engine development and emissions issues, sources briefed on the probe said. U.S. regulators said FCA failed to disclose engine management software in 104,000 U.S. 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3.0-liter diesel engines. The European Commission has launched legal action against Italy for failing to respond to allegations of emission-test cheating by Fiat Chrysler in a procedure that could lead to the country being taken to court. The EPA has said the maximum possible fine against FCA could be $4.6 billion. In February, FCA said it had received requests for information and subpoenas from U.S. federal and state authorities, including the Securities and Exchange Commission, for diesel issues.

Volkswagen preparing Tiguan Coupe R

Volkswagen has might proliferation plans for the SUV side of the VW brand, Autocar listing a range that will comprise seven models and variants on sale by 2018. The next-generation Tiguan will play a large part in tripling VW's crossover lineup, a development discussed a year ago, with a standard model, the three-row long-wheelbase version to be built in Mexico, and a five-door "Coupe" variant that will get an R version worked up by the in-house R team. The Tiguan Coupe R is aimed at the performance end of the compact crossover field, giddyup coming from a 2.0-liter four-cylinder with something like 300 horsepower and 280 pound-feet of torque that works through a six-speed dual-clutch transmission. Underpinnings are expected to be cribbed from the Golf R; a hotter suspension tune with a lower ride height and four-mode damping. The sprint to 62 miles per hour would clock in around 5.1 seconds, and handling nous would be aided by all-wheel drive and electronic torque vectoring. It will need all of that in order to catch up to the competitive set listed by Autocar of the 375-hp Mercedes-AMG GLA45, 309-hp Audi RS Q3, and potential Range Rover Evoque SVR and BMW X2 M. The CrossBlue Coupe seen in Shanghai earlier this year will provide the styling cues, we're told, with rakish glass front and back, and thick C-pillars supporting a leaner greenhouse. We'll likely see the basic Tiguan at next month's Frankfurt Motor Show, then will come the long-wheelbase in 2016, the regular Coupe in 2017 along with the Touareg and US-built CrossBlue, then in 2018 the Tiguan Coupe R, CrossBlue Coupe, and Nissan Juke-fighting T-Roc. VW will reportedly offer cash to cheated diesel car drivers

If you're feeling burned by Volkswagen's decision to cheat on diesel emissions tests, you might get some compensation for your troubles. Sources for The Truth About Cars understand that VW will launch a "TDI Goodwill Program" that compensates diesel car drivers with cash in the form of prepaid cards. In the US, you'd get both a $500 universal card as well as a VW-only card worth $500 to $750. The automaker isn't confirming details just yet, but it tells the New York Times that it's planning an announcement on Monday. Dealers also tell the newspaper that they're aware of a program in the works, although they don't know the specifics. It may not include the expanded range of cars reportedly tainted by the scandal, though, since VW is denying claims that it cheated with some models. This isn't the only olive branch VW has been offering: it's been handing out deals to existing owners willing to hop into new vehicles, and there are more discounts than usual across the board. However, the goodwill effort would represent the first instance of VW directly compensating drivers who'd previously thought they were getting an eco-friendly machine. This isn't going to make up for years of unnecessary pollution, but it may represent the company's best hope of holding on to customers.
