Toyota settles first wrongful death suit related to unintended acceleration

Toyota's sales seem to have rebounded from the unintended acceleration issues from 2009 and 2010, but the automaker is far from done dealing with this situation. Following a settlement worth up to $1.4 billion for economic loss to affected vehicle owners, Toyota has settled rather than going to trial in a wrongful death lawsuit stemming from an accident in Utah in 2010 that left two passengers dead. This isn't the first case in which Toyota has settled, but it was the first among a consolidated group of cases being held in Santa Ana, CA.
According to The Detroit News, this case was scheduled to take place next month, and it was for a November 2010 incident in which Paul Van Alfen and Charlene James Lloyd were killed in a Camry when, based on findings by the Utah Highway Patrol, the accelerator got stuck causing the car to speed out of control and hit a wall; the terms of the settlement were not announced.
The article says that while Toyota will settle on some cases, it doesn't plan on settling on all of them as it still wants to be able to "defend [its] product at trial." This will probably be the case in suits claiming that software for the drive-by-wire accelerator was the cause of an accident in a Toyota or Lexus vehicle. The question of whether or not the electronic accelerator played any role in this problem has been a hot-button topic since the beginning. Toyota has issued recalls in the past to attempt to prevent unintended acceleration caused by trapped floor mats and faulty accelerator pedals, but it also says driver error was to blame in some instances.

Toyota recalls 52k units of 2011-2012 Avalon for potential short circuit

Toyota is issuing a recall for roughly 52,000 examples of its 2011 and 2012 Avalon sedans in the US because a possible short circuit in the wiring for audio system's subwoofer may cause a fire. According to Toyota, it's possible for the subwoofer's wires to move out of position if contacted by cargo in the trunk. If one of the wires then contacts the metal frame of the speaker, it could trigger a short circuit. "If this occurs, the subwoofer could overheat, increasing the risk of a fire," according to the automaker. "There were two reports of thermal events – no outright fires," said Toyota spokesperson Cindy Knight to Autoblog. Toyota reports there are no reports of injuries, fatalities or crashes from this problem. Dealers will repair this problem at no cost, but until then, they will immediately disconnect the rear subwoofer as a precaution for owners. The recall notices will be sent out in mid-February, according to Knight. In the involved vehicles, cargo could contact one of the audio system subwoofer wires located inside the trunk, and move the wire out of its normal position. If one of these wires contacts the metal frame of the subwoofer, it may result in an intermittent short circuit. If this occurs, the subwoofer could overheat, increasing the risk of a fire. Toyota is not aware of any crashes, injuries, or fatalities caused by this condition. Owners of the involved vehicles will receive a notification by first class mail. Toyota dealers will provide a repair for the audio system. Until the remedy is available, as a precaution, Toyota dealers will disconnect the rear subwoofer. Toyota assembles the Corolla at plants around the world: from Brazil and South Africa to Turkey, Pakistan, China, Taiwan and Thailand. But the one we get here is built in Mississippi, and that location has just finished its 500,000th Corolla. The plant in Blue Springs, MS, is just one of a half-dozen assembly plants Toyota operates in the United States, but reached the half-million mark faster than any of the others. It began production late in 2011 and took over Corolla assembly from the NUMMI plant in California previously operated via joint venture with General Motors and now occupied by Tesla.
