First Toyota unintended acceleration case headed for trial

Toyota is going to be back in the spotlight, as the first of its unintended acceleration lawsuits is headed for trial. This case covers a Los Angeles sushi shop owner, Noriko Uno. According to the what the family told The Detroit News, Uno only put about 10,000 miles on her 2006 Toyota Camry in four years. Uno was apparently afraid of high speeds, avoiding the freeway and taking a route home along LA's surface streets to avoid them.
On August 28, 2009, Uno's Camry suddenly accelerated to 100 miles per hour, eventually striking a telephone poll and a tree and killing her. The family contends that Uno attempted to step on the brakes and pull the emergency brake, neither of which brought her speed under control, while Toyota maintains that improperly installed floormats and driver error have been behind the majority of the 80 cases expected to be heard in court.
In Uno's case, The Detroit News is expecting the trial to focus on the lack of an override if the gas and brake pedals were pressed at the same time. Brake overrides were installed on Toyota's European fleet. The Uno family attorney will need to prove to the jury that it wasn't driver error that killed Noriko Uno.

Toyota profits up 23% on high US sales, despite mounting legal costs

Toyota earned $9.3 billion in net income in the financial year that ends next month. The number beats earlier forecasts and marks a five-year high for the automaker, with both operating income and revenue up by 9.5 percent and 2.5 percent, respectively. Toyota saw quarterly profit enjoy a year-on-year jump of 23.4 percent, with the manufacturer earning more than $1 billion between October and December 2012. The good news comes in spite of the fact that the Japanese automaker actually endured an operating loss in North America, due in part to legal fees.
Toyota is set to pay more than $1 billion to owners who claim their vehicles decreased in value as a result of the company's recent spate of recalls. Even so, all three of the automaker's brands enjoyed a 13.5 percent sales increase in the US in the last quarter, beating the industry average. Toyota faltered in Europe, however, where it earned $99 million in operating profit last year, compared to $111 million in 2011. With considerable manufacturing capacity here in the United States and even a NASCAR program, it'd be all too easy to categorize Toyota as an American automaker. Only it's not. It's Japanese, of course. And back in the Japanese Domestic Market, it offers a whole range of models we'll never see in North America. Models like the Crown sedan, Noah minivan and this, the new Passo hatchback.
Sold in various markets as the Daihatsu Boon, Daihatsu Sirion, Perodua Myvi and (for a time) the Subaru Justy, the Toyota Passo is a compact hatchback that slots in size-wise between the Yaris sold in America and the Aygo offered in Europe (except the Passo is taller than either).
Power comes from a 1.0-liter engine with 69 horsepower that can be had in front- or all-wheel drive, or a 1.3 driving 95 horses to the front wheels alone. A continuously variable transmission is on duty regardless of engine choice. Front-drive models get a stop/start system, but even all-wheel-drive versions are eligible for government tax credits. That's because, though the new Passo only appears to be mildly updated, the engines have been thoroughly reworked to deliver 30-percent better fuel economy than the previous model, coming in 20-percent better than the standards being enacted by the Japanese government for next year.
