Is Tesla under investigation from the SEC? *UPDATE

UPDATE: Tesla spokesperson LIz Jarvis-Shean told AutoblogGreen that "We don't comment on rumor and speculation." Let's call this one unsubstantiated at best. Probes Reporter is a site that tries to figure out what's going on behind the scenes by filing a number of Freedom of Information Act (FOIA) with the Security Exchange Commission (SEC). Based on the responses it gets, it guesses whether or not the SEC is investigating companies. Earlier today, Probes Reporter issued a Tweet that says: "Tesla Motors May Have an Undisclosed SEC Probe - Added to Watch List." Probe Reporter says that it got a letter from the SEC in early October that cited the "law enforcement exemption" of the FOIA in order to deny PR access to the records it was asking for. PR says that this acknowledges "some sort of investigative activity." Probe Reporter also says that about two-thirds of these sorts of exemptions "are confirmed on appeal," so the company's history with this strategy indicates there is a real chance the electric automaker is indeed facing some sort of investigation. Again, we don't know anything for certain. For now, Tesla hasn't made any official statement on the matter (we've asked, and will update this if we hear anything) and the stock market doesn't seem to care. TSLA was up 1.62 percent today, to $246.72, in part because analysts say this is just a rumor at the moment, according to ValueWalk.

How Tesla is getting around Michigan's 'no sales' law

A fully-charged Tesla Model S can get from Detroit to Toronto if the driver doesn't have a lead foot. A more important US-Canada city tour would be from Detroit to Windsor, Ontario, which is only a two-mile journey through the Detroit Windsor Tunnel. This is key, because Tesla is thinking some Michigan folks will make that trip to check out the all-electric Model S, perhaps rattling some political cages as well. The California automaker recently drummed up some Detroit/Windsor-area exposure by holding Model S test rides in Windsor, according to CBC News. While the act itself isn't that brazen, it's a not-so-subtle dig at the state that the Big Three US automakers call home and which recently joined the ranks of states that take a hardline approach against Tesla legally selling its vehicles directly to customers. Michigan joined states like Texas, New Jersey, Maryland, Virginia and Arizona requiring the automaker to work through third-party dealerships. Michigan Governor Rick Snyder said that House Bill 5606, "doesn't change current law at all," but if Canada all of a sudden gets a lot of positive attention for being more open and Tesla's online sales rise, perhaps some minds will change.

A couple who won a Toyota Mirai at the Los Angeles Auto Show are among the first people to own the new fuel-cell sedan. Marianne Ellis bought the winning ticket - auctioned off by the Environmental Media Association to fund environmental programs - as a possible 30th anniversary gift for her husband, David. The excited couple picked up their ceremonial keys at the LA Auto Show on Wednesday. "For us, it's about being at the cutting edge of change," says Marianne Ellis. "It's a chance to support environmental causes and clean energy, while showing it's possible to make a car like this part of your lifestyle." The salaries for 6,500 full-time employees at Tesla's Gigafactory battery production facility have been reported. According to the Reno Gazette-Journal, the 4,550 production associates and 200 material handlers will be paid $22.79 an hour. 460 equipment technicians and 360 quality technicians will get $27.88 an hour. 930 engineers and senior staff will earn $41.83, or $87,000 a year. The National Biodiesel Board (NBB) has elected its governing board members. The board leaders include Sprague Operating Resources Chairman Steven J. Levy, Minnesota Soybean Processors Vice Chair Ron Marr, American Soybean Association Treasurer Mike Cunningham and Nebraska Soybean Board Secretary Greg Anderson. NBB also filled four more spots on the board, discussed federal policies, began program planning and recognized outstanding member involvement in the biodiesel industry. The DOE calls electrolysis, photoelectrochemical, biological and solar-thermochemical key areas of hydrogen production and has made advances in each. The DOE is looking into technological advancements in making the clean fuel and ways to reduce production costs. The DOE has also outlined various plans for the 2015 fiscal year with regard to advancing hydrogen technology, with the goal of getting hydrogen prices in line with other fuels. When someone achieves as much as Elon Musk has, it's easy to become fascinated not just with what the person is doing, but who that person is on a personal level. Sure, many of us are curious about what the future of Tesla or SpaceX looks like from inside the mind of its CEO, but some of us are also curious what he eats for breakfast. In a recent interview with Auto Bild, the German interviewers do a great job of getting Musk to open up about his business plans, his daily habits and even some of his deeper, more meaningful musings. "Nobody should be CEO forever." – Elon Musk Musk says he would likely remain CEO of Tesla Motors for three or four more years, at least long enough to see volume production of the upcoming Model III and building of the Gigafactory (for which Musk was able to command enormous incentives from the state of Nevada). "I will never leave Tesla forever, but I may not be CEO forever," Musk said. "Nobody should be CEO forever." When hiring, Musk looks for "evidence of exceptional ability" and "a track record of exceptional achievement." That does not necessarily include a college degree. "If you look at, say, people like Bill Gates or Larry Ellison, Steve Jobs, these guys didn't graduate from college, but if you had a chance to hire them, of course that would be a good idea." At an interesting point in the conversation, the interviewers ask Musk to describe himself. He says that he has an innate sense of drive and that he seeks the truth, but it's interesting to watch him dig deep to come up with an answer. "All these introspective questions are interesting," he said. "I don't get asked these very often." Musk goes on to talk about how he originally expected both SpaceX and Tesla to fail, how he lived on borrowed money to keep his companies afloat and even how he'd like to die on the planet Mars. Car and Driver 10Best list cracked by Tesla Model S, BMW 3 Series left off

Car and Driver is keeping new blood pumping into its annual 10Best cars list with three new entries making it on for 2015 and a perennial favorite falling off. Among the biggest shocks this year is that the BMW 3 Series and 4 Series are no longer named, despite years of some portion of that lineup earning a mention. In another surprise, the Tesla Model S (specifically in S 60 trim to fit under the $80,000 cost cap) makes it to the 2015 roster and is the only electrically motivated member of the group. Despite the loss of the 3 Series, BMW isn't entirely shut out this year, because the M235i gets its name on the list. Car and Driver argues that the little coupe feels like a welcome throwback to the E46 chassis M3 of the early 2000s. In addition to the Model S, the final newbie to the annual group is the 2015 Ford Mustang GT. The inclusion of these new members knocks the Audi A6/A7 family and Ford Fiesta ST out from the 2014 rundown. The other seven models carry over from last year, including the Cadillac CTS, Chevrolet Corvette Stingray, Honda Accord, Mazda3, Mazda6, Porsche Boxster/Cayman and Volkswagen Golf/GTI. The 2015 10Best cars list certainly seems to have something for everyone from the hot hatch fan to the family man and even the green car driver, thanks to the addition of the Tesla. Tesla has revealed the details of the upgrade of its Fremont, CA factory. One major change is the addition of a dedicated production space for the dual-motor P85D version of the Model S. Robots will be doing the battery installation on the Model S to save some time, and new export docks allow Tesla to get the cars out the door and on the way to their new owners more quickly. The new robots that move the cars around the factory have been named after X-Men characters, which makes our inner geeks smile. Of the 1,424 lottery winners, only about 30 percent went on to register an electric car despite a two-month extension of the deadline to do so. Buyers are likely discouraged by the lack of charging infrastructure, which the city hopes to ameliorate with the addition of 1,000 new charging stations by the end of the year, and by requiring new and renovated developments to set aside parking specifically for EV charging. Read more at Green Car Reports. The UC Davis Institute of Transportation Studies suggests that laws designed to protect dealers and consumers are stymieing the adoption of EVs. Laws like the ones certain states have in place that block or otherwise restrict Tesla's direct-to-consumer business model are not helpful for companies that want to introduce new products to the market. They prevent companies from passing on savings to customers for whom they would likely make the difference in a purchasing decision. One possible solution would be to allow exemptions to certain selling restrictions for a certain number of vehicles sold. "This could give automakers the degree of control needed to work out kinks with early customers, develop scalable processes for supporting PEVs, and ensure that effective dealer performance standards are in place before handing the reins over to wholly independent retailers," according to UC Davis ITS. The main purpose of the program is to move toward eco-friendlier carmaking at each of its plants worldwide.

Elon Musk shuts down speculation that Falcon Wing doors will disappear

Since learning that deliveries of the Model X from Tesla Motors would now be delayed until sometime next summer, speculation has focused on the rear doors of the electric SUV as the likely source of the problem. We think this is a pretty good assumption considering that CEO Elon Musk said as much himself. Called falcon wing doors because they are said to resemble that bird of prey in flight, they open upwards, hinging in two places – the somewhat similar gull wing doors only have one hinge, where they're attached to the roof – which allows them to be opened in tighter spaces than the sea bird design. While the original prototype of the Model X had working wings, the engineering for a production model is no doubt a lot more difficult. Noted analyst Adam Jonas of Morgan Stanley said yesterday in a report that cut delivery estimates of the postponed car, "A door of that size and weight is going to be very hard to lift. Furthermore, having a hole of that size in the side of the car (that cuts deeply into the roof) could severely compromise structural rigidity impacting handling and safety." While the challenges of the unique rear portals make some investors wish Tesla would just stick with traditional openings, Musk made it clear that the falcon wings are going forward. Tesla Model S reduces colors with new options

The Tesla Model S is no longer a "green" car. Or brown, for that matter. Call it a case of streamlining. The California-based automaker will reduce the option choices for the Model S by reducing the number of variants and colors available on its only production vehicle. Elon Musk made the announcement on the company's conference call with analysts earlier this month. Musk said: We've had to make some tough decisions on essentially having fewer versions of the Model S in order to streamline manufacturing and thus be able to ramp production better and have better control in logistics and not have like a million variations on the Model S. The dual motors, we're not going to produce the dual motor 60-kilowatt hour car at all. We're not taking additional orders for the performance 85. We're only doing the performance 85 dual motor and we're cancelling green and brown as colors. These are a few examples, but this helps us streamline the manufacturing and supply chain logistics and enables us to better ramp production. Additionally, there will no longer be an all-wheel-drive version of the 60-kilowatt-hour Model S. Tesla announced its third-quarter results earlier this month, saying it had a record-high 7,785 deliveries for the three-month period. By the end of next year, the company hopes to be knocking out 2,000 vehicles a week, which would put Tesla over the 100,000-annual-vehicle threshold. And with fewer colors to choose from, too.

Tesla wants court to dismiss Georgia dealer lawsuit

Like the fire that forced Rhett Butler and Scarlett O'Hara to flee Atlanta in Gone With the Wind, the battle between Tesla Motors and Georgia's auto dealers is heating up. In late August, the Georgia Automobile Dealers Association (GADA), which represents about 500 dealerships, filed a petition to prevent Tesla from selling its electric vehicles in the state. Tesla is now requesting a Georgia judge to throw out the petition, the Atlanta Business Chronicle says. The issue, as with states such as Texas, New Jersey, Virginia and Arizona, is that dealers say Tesla violates state law by selling vehicles directly to consumers instead of through third-party dealerships not owned by the company. Tesla insists that the company is best suited to oversee all distribution channels because of the uniqueness of the product and plans to open stores in Atlanta's Buckhead area and Decatur next week. The judge won't hear the case until next month. For now, Tesla is allowed to sell as many as 150 vehicles a year in Georgia under a zero-emissions vehicles provision. There's precedent elsewhere for things to improve in states where Tesla and dealers clashed. In August, the company reached a compromise with the state of Pennsylvania that will allow Tesla to open five stores in that state. Of course, there is a precedent for things to go the other way, too.

Biofuel company KiOR has filed for bankruptcy. KiOR, which was born out of a partnership between Khosla Ventures and Dutch biofuel startup BIOeCON, has debts numbering $261.31 million, with just $58.27 million in assets. The company produced biocrude from cellulosic biomass, but was unable to meet its production targets at its facility in Columbus, MS, and was also facing quality problems and accused mismanagement. KiOR shuttered its biocrude plant earlier this year, and suffered a huge loss in stock value. Read more at Gigaom. Some Tesla Model S owners are complaining again of "vampire" drain during sleep mode. Since downloading the Firmware 6.0, some drivers have reported a battery draw, even when set to "sleep always." Losses can be up to 12 miles of range from sitting overnight, and the latest versions of 6.0 haven't seemed to have solved the problem. Interestingly, the problem isn't affecting all Model S owners. Also, battery draw problems have been reported in the past, which Tesla took steps to fix in previous firmware updates. Read more at Inside EVs. Daimler's Car2go carsharing service is expected to reach 1 million users by the end of the year. The company currently reports 900,000 users worldwide. Car2go operates in 29 cities in North America and Europe, with plans to expand operations to China. "China might be risky, but it also brings lots of opportunities," says Daimler's Rainer Becker. While Car2go has yet to make a profit as a whole, it is moving in that direction, with Becker saying some cities' operations are already profitable. Read more at Automotive News Europe. The ELF solar- and human-powered trike from Organic Transit is now available as a two-seater. The ELF 2FR, as it is called, is a package that adds a rear seat behind the driver of the pod-shaped EV to allow for eco-friendly transport of two adults. The standard ELF retails for $5,495, and the upgrade to the 2FR adds another $499 to the price, which seems like a small premium for doubling the occupancy. Organic Transit hasn't released all the details on its website for the 2FR yet, but the standard ELF charges via outlet or 100-watt solar panel, goes 20 miles per hour and gets the equivalent of 1,800 miles per gallon (though adding the weight of another adult will certainly change those mileage numbers).
