Carlos Ghosn sues Nissan-Mitsubishi in the Netherlands

AMSTERDAM — Carlos Ghosn has launched a court case in the Netherlands against Japanese carmakers Nissan Motor and Mitsubishi Motors, who ousted him as chairman of their alliance last year on charges of embezzlement, Dutch newspaper NRC reported on Saturday. Ghosn is seeking 15 million euros ($16.8 million) in damages from the carmakers, as grave mistakes were made when he was sacked, NRC reported, citing his lawyer. "In the Netherlands, if you want to fire an executive you have to first tell him what he's being accused of, and you have to provide him with the evidence for the accusations. Neither of those things has happened," lawyer Laurens de Graaf told NRC. Ghosn fell from grace late last year when he was arrested in Japan and sacked by Nissan on charges of financial misconduct, which he denies. He has also been fired as the CEO and chairman of French carmaker Renault. Ghosn was freed in April from jail in Japan on a $4.5 million bail. Among other charges of fraud and misconduct, Nissan and Mitsubishi have said Ghosn improperly received $9 million in compensation from their joint venture. Suspect expenses Ghosn made when he chaired Renault and Nissan amounted to about 11 million euros, Renault's board said in June. Ghosn holds French, Lebanese and Brazilian citizenship, but opted for the fiscally more friendly Netherlands as his tax domicile in 2012. The holding company for the Nissan-Mitsubishi alliance is also incorporated in the Netherlands. The district court in Amsterdam is reviewing the case but has not set a trial date yet, NRC said. Nissan's current Rogue renamed Rogue Select, will live alongside next gen

Despite the fact that an all-new generation of its Rogue crossover goes on sale in November, Nissan will continue to sell the current model alongside its replacement. The existing C-platform-based Rogue, which will be renamed Rogue Select, will start at less than $20,000 when it goes on sale in January 2014. At present, a base 2013 Rogue S prices out slightly higher, from $20,310, but we wouldn't be surprised to see the 2014 Rogue Select come to market with more standard equipment and simplified trim options. It will continue to be built in Kyushu, Japan.
According to Nissan, the unusual move is "to satisfy demand for the popular compact sports utility vehicle, currently second-highest seller in Nissan's lineup, as well as provide customers an additional choice in the segment." It's hard to hard to argue with the numbers: Nissan cites 2012 calendar-year sales of 142,349 Rogue units in the US, with 2013 sales increasing 16 percent through August despite the vehicle's age.
The strategy may also give Nissan the chance to ask for more money for the second-generation model (which is based on a new Common Module Family platform shared with partner Renault) while keeping it clear of residual-value-damaging fleet sales. The new Rogue looks to be both larger and more luxurious, with an available third-row seat, and it should be more economical to produce, as it will be built in Nissan's Smyrna, TN plant.

Ghosn took bullet train to Osaka en route to Lebanon

Japanese authorities also said on Monday they may still press for Ghosn's extradition from Lebanon to face multiple charges of financial wrongdoing, even though the country does not normally extradite its nationals. Security cameras captured Ghosn leaving his home on Dec. 29 at about 2:30 p.m. (0530 GMT) and arriving some hours later at Tokyo's Shinagawa Station, where he took the train 300 miles to Shin Osaka Station, Kyodo said, citing a person familiar with the matter. The international fugitive then went by car to a hotel near Osaka's Kansai International Airport, where he boarded a private jet at 11:10 p.m., according to the media report. Ghosn was forbidden from leaving Japan while awaiting trial on charges of financial misconduct, which he has denied, but he fled at the end of 2019 to escape what he called a "rigged" justice system. Prosecutors are now working with police to piece together Ghosn's route and find out who helped him, Kyodo said. In the government's first briefing since Ghosn skipped bail, Justice Minister Masako Mori said on Monday that as a general principle, Tokyo could request the extradition of a suspect from a country with which it has no formal extradition agreement. Such a request would need to be carefully examined based on the possibility of "guaranteeing reciprocity and the domestic law of the partner country," Mori told reporters in Tokyo.   Arrest warrant Mori did not say what would guarantee reciprocity (the idea that benefits or penalties extended by one country to citizens of another should be reciprocated). She also did not say if there were any Lebanese nationals in Japan wanted in Lebanon. Mori offered little insight into the events of Ghosn's escape to his ancestral home, repeatedly saying she could not comment on specifics because of an ongoing investigation. Japanese officials broke days of silence about the Ghosn case on Sunday, saying they would tighten immigration measures and investigate his escape thoroughly. The authorities have also issued an international notice for his arrest.
