Carlos Ghosn changes to hotshot attorney and a new defense strategy

TOKYO — Carlos Ghosn's chief defense attorney Motonari Otsuru resigned and was replaced by a team that includes hotshot lawyer Junichiro Hironaka, in a change of strategy from the ousted Nissan Motor chairman three months after his arrest. Ghosn, Nissan's one-time savior, has been held in detention since his Nov. 19 arrest. He's been indicted and accused of under-reporting his salary and breach of trust. He has denied the charges. The once-feted auto executive hired Hiroshi Kawatsu as head of a new defense team, his office said on Wednesday. Hironaka, 73, has won several high profile cases, helping acquit senior lawmaker Ichiro Ozawa and senior bureaucrat Atsuko Muraki. Hiring Hironaka would mean a more aggressive legal strategy, said Nobuo Gohara, a former prosecutor. Otsuru previously led the special prosecutors' office that is now handling Ghosn's case. "Otsuru was miscast. He worked at the heart of the special prosecutors office so he was not someone who was going to go after them aggressively," Gohara said. "Hironaka is an experienced defense lawyer who has won a number of cases. He will mount a more thorough and aggressive defense." Otsuru's office confirmed his resignation in a statement, but gave no reason for the move. A second member of Ghosn's defense team, Masato Oshikubo, had quit, it said. Go Kondo, Ghosn's third defense lawyer, was unavailable for comment. Ghosn released a short statement thanking Otsuru for his team's "tireless and diligent work," and called him a "very capable and intelligent man and lawyer." The sudden change in attorneys comes ahead of the expected start of informal meetings with prosecutors and judges to discuss pretrial preparations, an indication that there will be no new charges against Ghosn. "As we begin the trial phase, I have decided to engage Hironaka-sensei as my legal counsel," Ghosn said, using an honorific suffix. "I look forward to defending myself vigorously, and this represents the beginning of the process of not only establishing my innocence but also shedding light on the circumstances that led to my unjust detention." Ghosn, 64, told the Nikkei newspaper last month that Nissan executives opposed to his plans for closer ties with automaking partner Renault SA had plotted to remove him. Ghosn was widely credited with rescuing Nissan from near-bankruptcy after he was brought over to Japan in 1999 by Renault after the French automaker bought a chunk of Nissan.

Recharge Wrap-up: Nissan earns Energy Star award, ethanol production forecasts adjusted

The US Energy Information Administration has adjusted its ethanol production forecasts. It predicts an average of 944,000 barrels per day for 2015. That number is up from 2014 production levels of 935,000 barrels per day, but it is lower than last month's projection for 2015, which was 947,000 barrels per day. The EIA forecasts 937,000 barrels per day in 2016, down from its prior forecast of 942,000 barrels. Walsh supports the proposed Diesel and Vehicular Emissions Ordinance. The ordinance, filed by City Councilor Stephen Murphy, would require emissions control retrofitting of all pre-2007 vehicles belonging to the City of Boston, as well as those of any contractors it hires. The ordinance also seeks to create a simple city-level standard of enforcing the state's anti-idling laws. "The asthma rate in Boston's neighborhoods continues to climb," says Councilor Murphy. "By further tightening air quality standards, as this ordinance does, we will make Boston's neighborhoods healthier." Read more at DieselNet. The Michigan Blue Economy report profiles Ford for its water-saving sustainability efforts. The report notes that Ford reduced its water use by 61 percent, or 10 billion gallons, from 2000 to 2013 by "cutting the water used in everything from cooling towers to paint operations." As part of its Global Water Management Initiative, Ford has decreased its total water use at its facilities worldwide from 64 million cubic meters per year to 25 million cubic meters. The automaker received the Sustained Excellence Award for its efforts to reduce energy use and greenhouse gas emissions in its operations. Nissan reduced the amount of energy used to build vehicles by 13 percent in 2014. Energy reduction efforts include switching to LED lighting and developing an environmentally friendly paint process. Nissan also works with schools in Tennessee and Mississippi to help them reduce energy usage. Angry Nissan Leaf Driver may make 'Rolling Coal' illegal in New Jersey

It's always a few bad apples who ruin polluting just for fun for the rest of us. That time-honored American tradition of being rude for laughs, otherwise known as 'rolling coal,' might become illegal in New Jersey, if a Nissan Leaf-driving politician gets his way. The politician in question is State Assemblyman Tim Eustace (D-Bergen), who was purposefully hit by a blast of dark smoke recently while driving his Leaf on the New Jersey Turnpike, according to NJ.com. This personal experience of what he called "just youthful ignorance" is encouraging him to submit a bill (A3583), which, "Prohibits retrofitting diesel-powered vehicles to increase particulate emissions for the purpose of 'coal rolling'; prohibits the practice of 'coal rolling.'" If you're caught violating the law, you would be hit with a fine from the state Department of Environmental Protection. Of course, the Feds say it is already illegal to modify an exhaust system in a way that allows coal rolling. Rolling coal has become a bit of a meme recently, with videos of laughing truck drivers spewing their modified exhaust pipes at green cars, pedestrians and bikers around the country. Eustace told NJ.com that, "People had been telling this has been going on, but I hadn't seen it. I was surprised to experience it myself."
