Carlos Ghosn changes to hotshot attorney and a new defense strategy

TOKYO — Carlos Ghosn's chief defense attorney Motonari Otsuru resigned and was replaced by a team that includes hotshot lawyer Junichiro Hironaka, in a change of strategy from the ousted Nissan Motor chairman three months after his arrest. Ghosn, Nissan's one-time savior, has been held in detention since his Nov. 19 arrest. He's been indicted and accused of under-reporting his salary and breach of trust. He has denied the charges. The once-feted auto executive hired Hiroshi Kawatsu as head of a new defense team, his office said on Wednesday. Hironaka, 73, has won several high profile cases, helping acquit senior lawmaker Ichiro Ozawa and senior bureaucrat Atsuko Muraki. Hiring Hironaka would mean a more aggressive legal strategy, said Nobuo Gohara, a former prosecutor. Otsuru previously led the special prosecutors' office that is now handling Ghosn's case. "Otsuru was miscast. He worked at the heart of the special prosecutors office so he was not someone who was going to go after them aggressively," Gohara said. "Hironaka is an experienced defense lawyer who has won a number of cases. He will mount a more thorough and aggressive defense." Otsuru's office confirmed his resignation in a statement, but gave no reason for the move. A second member of Ghosn's defense team, Masato Oshikubo, had quit, it said. Go Kondo, Ghosn's third defense lawyer, was unavailable for comment. Ghosn released a short statement thanking Otsuru for his team's "tireless and diligent work," and called him a "very capable and intelligent man and lawyer." The sudden change in attorneys comes ahead of the expected start of informal meetings with prosecutors and judges to discuss pretrial preparations, an indication that there will be no new charges against Ghosn. "As we begin the trial phase, I have decided to engage Hironaka-sensei as my legal counsel," Ghosn said, using an honorific suffix. "I look forward to defending myself vigorously, and this represents the beginning of the process of not only establishing my innocence but also shedding light on the circumstances that led to my unjust detention." Ghosn, 64, told the Nikkei newspaper last month that Nissan executives opposed to his plans for closer ties with automaking partner Renault SA had plotted to remove him. Ghosn was widely credited with rescuing Nissan from near-bankruptcy after he was brought over to Japan in 1999 by Renault after the French automaker bought a chunk of Nissan.

Junkyard Gem: 1996 Nissan Quest XE with 338,549 miles

When I hit the junkyard, I always look for vehicles with impressive final figures showing on their odometers. I find so many Hondas and Toyotas with better than 300,000 miles that I don't consider them especially noteworthy (the exception being super-low-spec cheap models, such as a Tercel or Civic VX), and it goes without saying that the bar is quite high for Mercedes-Benzes as well. It has been surprisingly difficult to find discarded Nissans that made it past the 300k mark; today's Junkyard Gem is just the fourth I've documented. The highest-mile junked Nissan I'd found prior to today's minivan is a 1994 Maxima with 364,238 miles, followed by a 1987 Maxima with 341,176 miles and a 1986 200SX with 309,222 miles. Keep in mind that Nissan didn't go to six-digit odometers on most of its US-market cars until the early 1980s, and then went to tough-to-read-in-the-junkyard electronic odometers in the early 2000s; this means the pool of potential high-mile Nissans is limited to about the 1983-2000 range of model years. Ford has just as much right to claim credit to this van's impressive mile total as does Nissan, since the Quest was a collaboration between Ford and Nissan that also produced the Mercury Villager; this van was built by Ford at the Ohio Assembly plant. The Quest/Villager platform was derived from the Maxima's, and the engine is pure Nissan: a 3.0-liter VG30 V6 rated at 151 horsepower. The only transmission available in the first-generation (1993-1999) Quest/Villager was a four-speed automatic. This one appears to have been sold new at Landrum Nissan in Pueblo. The rear glass has been painted flat black, possibly to keep prying eyes from seeing valuable cargo. The rear seats are long gone, so this van probably hauled cargo for much of its long life. The front interior seems to be in good shape. Why is this van here? There's body damage on the left rear and right front, suggesting a crash that may have bent the suspension past the worth-fixing threshold. Fiat contemplating sub-brand to compete with Dacia, Datsun

You can add Fiat to the admittedly short list of automakers considering a low-cost brand to rival Dacia. The inexpensive Eastern European brand from Renault-Nissan has performed on the balance sheet like a premium model line, and the money the alliance is taking off the table is encouraging other players to deal themselves in. Pretty soon Nissan's Datsun sub-brand will join the Dacia party, going on sale in Russia, Indonesia and India and will claim even more rubles, rupiahs and rupees for the parent company. Volkswagen recently said it will make a decision this year on a budget line for the Chinese market. With the euthanasia of Lancia and plans to move the Fiat brand upmarket, company CEO Sergio Marchionne wonders aloud to Automotive News Europe whether there could be room for a new budget brand underneath Fiat.
We're told that the initiative has been in the idea box for five years and even moved to the stage of name considerations, like Innocenti, but worries about profit kept it from realization. If such a range were to be developed, Marchionne says it couldn't be built in Italy and stay within budget, and the company is "analyzing its manufacturing capacity outside of Europe to see if a low-cost brand is viable."
