Feds say Americans' bid to avoid extradition in Ghosn escape is 'flawed'

BOSTON — U.S. prosecutors on Tuesday said a former Green Beret and his son, wanted by Japan for helping former Nissan boss Carlos Ghosn flee the country, were advancing a "flawed" interpretation of Japanese law to fight their extradition. Michael Taylor and his son, Peter Taylor, were arrested in Massachusetts last month at Japan's request for allegedly smuggling Ghosn out of the country on Dec. 29, 2019, in a box while he was out on bail awaiting trial on financial charges. Ghosn fled to Lebanon, his childhood home, after being charged with engaging in financial wrongdoing, including by understating his compensation in Nissan's financial statements. He denies wrongdoing. Lawyers for the Taylors in a motion last week asked a federal judge in Boston to quash the provisional warrants issued in May for their arrests, arguing that "bail jumping" is not a crime in Japan. Defense lawyers argued that helping someone jump bail was also not a crime. While Japan issued arrest warrants for the Taylors in January, the lawyers said the crime stated in the warrants is an immigration offense and a non-extraditable misdemeanor. But U.S. prosecutors in a brief filed on Tuesday said it would be "unprecedented" for the extradition case at this junction to be tossed based on a "flawed interpretation of Japanese law and a mischaracterization of the facts." While Japan has not yet formally sought their extradition, the country has confirmed that Taylors' conduct constitutes a felony, U.S. prosecutors said. "The purported loophole through which the Taylors seek to evade justice simply does not exist," U.S. prosecutors wrote. Prosecutors added that neither Taylor, including Michael, a U.S. Army Special Forces veteran and private security specialist, should be released from jail as they are flight risks. A new Carnegie Mellon University study looks at the effects of regional climate variations on the Nissan Leaf. The study shows (unsurprisingly) that the ambient temperatures of different regions have effects on battery performance and the use of climate control, both of which affect range. Efficiency and grid mix determine regional differences in emissions per mile. CMU enumerated many of the differences in performance across the US. For instance, on the coldest day of the year, maximum range can be 70 miles on the Pacific Coast, while it is less than 45 miles in the Upper Midwest. These differences in efficiency can also affect adoption patterns. Read more at Green Car Congress. Battery charger manufacturer CTEK has licensed WiTricity wireless charging technology. CTEK looks to commercialize the wireless power transfer tech for use with electric vehicle batteries, making the "plug-in" aspect of EV charging unnecessary. WiTricity's charging technology stands out for its ability for distance charging via magnetic near field. Switching heavy trucking fleets from diesel to natural gas could make economic sense, but the environmental benefits aren't as certain, according to a new study from UC Davis and Rice University. Certain regions - particularly California, the Great Lakes and mid-Atlantic regions - could benefit from the switch with minimal investment. "But to have an environmental advantage for reducing greenhouse gas emissions would take significant policy intervention," says Amy Myers Jaffe, executive director for Energy and Sustainability at UC Davis. Recharge Wrap-up: Fiat 500X emissions, Japan EV sales down

The Fiat 500X exceeds EU emissions limits, according to environmental lobby group DUH. In dyno tests, DUH found NOx emissions in the diesel-powered 500X to be 11 to 20 times the limit with a warm engine, but closer to the limit with a cold engine. Testing of vehicles from Fiat and other automakers "point towards defeat devices," says DUH campaigner Axel Friedrich. Fiat Chrysler Automobiles (FCA) offered no comment in response to the accusations. Read more from Reuters. A UK study finds that about 20 percent of the benefits from fuel efficient vehicles are negated by a tendency for people to drive them more. The study, which covers the years 1970 to 2011, finds a significant "rebound effect," when consumers use more of a cheaper energy source. It suggests these drivers drive more not because of the fuel efficiency, but because of the lower operating costs. "Until now, we didn't know the size of this effect for British motoring," says Dr. Lee Stapleton, Research Fellow for the University of Sussex Centre on Innovation and Energy Demand. Japanese EV sales have declined for the first time ever. Sales of electric vehicles slid 22 percent in 2015, leaving them at the same levels as 2012. Low gasoline prices are to blame, as well as the late arrival of the updated Nissan Leaf, which caused potential customers to hold off on their purchase. This allowed the Mitsubishi Outlander PHEV to take the lead as Japan's best selling EV. The Toyota Prius Plug-In came in third place in EV sales, with the BMW i3 close on its heels.
