Carlos Ghosn was on verge of release — so prosecutors file new allegation

TOKYO — Japanese prosecutors added a new allegation of breach of trust against Nissan's former chairman Carlos Ghosn on Friday, dashing his hopes for posting bail quickly. Ghosn and another former Nissan executive, Greg Kelly, were arrested Nov. 19 and charged with underreporting Ghosn's income by about 5 billion yen ($44 million) in 2011-2015. They also face the prospect of more charges of underreporting Ghosn's income for other years by nearly 10 billion ($80 million) in total. The breach of trust allegations were filed a day after a court rejected prosecutors' request for a longer detention of both men. The new allegation only applies to Ghosn, and Kelly could still be bailed out. A request for bail by Kelly's lawyer is pending court approval, according to the Tokyo District Court, but his release will have to wait until next week since the request was still in process after office hours Friday. Prosecutors in a statement Friday alleged that Ghosn in 2008 transferred a private investment loss worth more than 1.8 billion yen ($16 million) to Nissan by manipulating an unspecified "swap" contract. Ghosn also profited by having the company transfer a total of $14.7 million to another company to benefit himself and that company's owner, who helped in the contract manipulation, prosecutors said. Shin Kukimoto, deputy chief prosecutor at the Tokyo District Prosecutors Office, refuse to say if the two transactions were related or how Ghosn illegally profited. He also declined to identify the collaborator or whether the transactions were made overseas. Ghosn and Kelly are only charged with underreporting Ghosn's pay over five years, in violation of the Financial Instruments and Exchange Act. They have not been formally charged with an additional allegation of underreporting another 4 billion yen ($36 million) for 2016-2018, for which their first 10-day detention was to expire Thursday. Prosecutors have been criticized for separating the allegations as a tactic to detain Ghosn and Kelly longer. They say Ghosn and Kelly are flight risks. The maximum penalty for violating the financial act is up to 10 years in prison, a 10 million yen ($89,000) fine, or both. Breach of trust also carries a similar maximum penalty. The conviction rate in Japan is more than 99 percent for any crime. Ghosn was sent by Renault in 1999 to turn around Nissan, then on the verge of bankruptcy, and he led its rise to become the world's second-largest automaker.

Nissan Leaf has outsold Chevy Volt by 50% so far in 2015

We know, we know. The Chevy Volt and Nissan Leaf sales numbers for mid- to late-2015 aren't all that meaningful because of the impending arrival of the next-gen Volt and the expected but not-yet-totally-confirmed debut of the second version of the Leaf. Nonetheless, tracking the sales of the first two major plug-in vehicles is something that remains interesting to us, if for nothing else that the all-electric Leaf remains slightly more popular than the plug-in hybrid Volt after all this time. If we just look at August, the numbers were basically tied in the US. Chevy sold 1,380 Volts while Nissan moved 1,393 Leafs. But when we take a 10,000-foot view, the differences starts to appear. So far in 2015, GM has sold 8,315 Chevy Volts while Nissan has sold 12,383 Leafs. That means that the Nissan has outsold the Chevy by around 50 percent (to be specific, it's 48.92 percent). Since the two vehicles went on sale in the US at roughly the same time at the end of 2010, 81,672 Volts have been sold, compared to 84,705 Leafs. That's a difference of only 3,033 vehicles, so proponents of both powertrains can hold their heads high. Looking just at last month, Volt sales were 45 percent lower compared to August 2014. So far this year, Volt sales are down 36.7 percent. The Leaf didn't fare any better. Month-to-month, Leaf sales were down 43.7 percent in August, while year-to-date, Leaf sales are down 65.3 percent. Arrest warrant for Ghosn's wife a 'pathetic' move by Japan, spokeswoman says

BEIRUT — A decision by Japanese prosecutors to issue an arrest warrant for Carlos Ghosn's wife shortly before the fugitive car boss was due to speak publicly about his case was "pathetic," a spokeswoman for Ghosn told Reuters on Tuesday. The ousted Nissan Motor and Renault chairman fled to Lebanon, his childhood home, in late December from Japan, where he faced trial for alleged financial misconduct. Ghosn is expected to speak on Wednesday at a news conference in Beirut and detail some of the claims he has made against Nissan since his arrest in November 2018. He has alleged there was a Japanese government-backed coup to oust him. It's his first such appearance since his arrest in November 2018. "Last time Carlos Ghosn announced a press conference and got re-arrested. This time, the day before he is announced to speak out freely for the first time, they issued an arrest warrant for his wife Carole Ghosn," the spokeswoman said. Japanese prosecutors issued the warrant for Ghosn's wife Carole for perjury, Japanese media reported. The spokeswoman said Carole Ghosn voluntarily went back to Japan nine months ago to answer prosecutors' questions and was free to go without any charges. "The issuance of this warrant is pathetic," she said. Japan is looking for a way to extradite Ghosn, but Lebanon and Japan have no extradition agreement and Lebanon does not normally extradite its own citizens. The perjury arrest warrant accuses Carole Ghosn of falsely claiming not to know, or to have met, people connected to a company that received payments from Nissan Motor, part of which it subsequently transferred to a firm owned by Ghosn. Separately, a senior Ministry of Justice official said staff were poring over Lebanese laws to find a way to return Ghosn and that Japan "will do whatever it can" to have him face trial.   Naming names at Nissan Ghosn is expected to detail some of the claims he has made against Nissan since his arrest. Citing an interview with Ghosn, Fox Business reported that he said he has "actual evidence" and documents to show there was a Japanese government-backed coup to "take him out." He plans to identify those he believes responsible, the broadcaster said.
