Feds say Americans' bid to avoid extradition in Ghosn escape is 'flawed'

BOSTON — U.S. prosecutors on Tuesday said a former Green Beret and his son, wanted by Japan for helping former Nissan boss Carlos Ghosn flee the country, were advancing a "flawed" interpretation of Japanese law to fight their extradition. Michael Taylor and his son, Peter Taylor, were arrested in Massachusetts last month at Japan's request for allegedly smuggling Ghosn out of the country on Dec. 29, 2019, in a box while he was out on bail awaiting trial on financial charges. Ghosn fled to Lebanon, his childhood home, after being charged with engaging in financial wrongdoing, including by understating his compensation in Nissan's financial statements. He denies wrongdoing. Lawyers for the Taylors in a motion last week asked a federal judge in Boston to quash the provisional warrants issued in May for their arrests, arguing that "bail jumping" is not a crime in Japan. Defense lawyers argued that helping someone jump bail was also not a crime. While Japan issued arrest warrants for the Taylors in January, the lawyers said the crime stated in the warrants is an immigration offense and a non-extraditable misdemeanor. But U.S. prosecutors in a brief filed on Tuesday said it would be "unprecedented" for the extradition case at this junction to be tossed based on a "flawed interpretation of Japanese law and a mischaracterization of the facts." While Japan has not yet formally sought their extradition, the country has confirmed that Taylors' conduct constitutes a felony, U.S. prosecutors said. "The purported loophole through which the Taylors seek to evade justice simply does not exist," U.S. prosecutors wrote. Prosecutors added that neither Taylor, including Michael, a U.S. Army Special Forces veteran and private security specialist, should be released from jail as they are flight risks. Nissan rowed the Note ashore [w/video]

Normally we wouldn't suggest trying to float your car on water, but Nissan has made some modifications to turn its new Versa Note hatchback into a makeshift rowing shell.
Nissan replaced the car's rear seats with a sliding rear rowing seat, modified the doors to open wider at 90 degrees and fitted a pair of oars. Most importantly, they put the whole thing on a floating platform to keep it from sinking into Eton Dorney Lake, the site of the 2012 Olympic rowing competitions in England (where the car is simply known as the Nissan Note).
Then they invited medal-winning competitive rowers Helen Glover, Sophie Hosking and Polly Swann to come along and row the thing, making use of the around-view monitor system to see where they were going. All in all it may not be quite as cool as the boats which Fiat made out of the 500 or Mini made out of its convertible, but it's still enough to float our boat. Carlos Ghosn's wife appeals to President Trump to help her husband

LONDON — The wife of former Nissan chairman Carlos Ghosn urged U.S. President Donald Trump to raise her husband's case with Japan's prime minister at a summit of world leaders later this month. "I'd like President Trump to speak to Prime Minister Abe about fair conditions, fair trial conditions and to let me speak to my husband and also to respect this presumption of innocence until proven guilty," Beirut-born Carole Ghosn, who has a U.S. passport, told the BBC. Shinzo Abe is due to host other leaders of the Group of 20 economies in the Japanese city of Osaka on June 28-29. In April Carole Ghosn called on the French government to do more to help her husband. Carlos Ghosn, who holds French, Lebanese and Brazilian citizenship, is facing financial misconduct charges and has said he is the victim of a boardroom coup, accusing "backstabbing" former colleagues of conspiring to oust him as Nissan chairman. Carole Ghosn said she had not spoken to her husband since he was re-arrested on April 4 before being released on bail three weeks later. "They told him one of the bail conditions, the restrictions, is he isn't allowed to speak to me or talk to me, which I find inhumane," she said. "All of this could have been dealt with internally within the company. This didn't need to go this far and on top of it my husband is innocent and time will prove the truth."
