Feds say Americans' bid to avoid extradition in Ghosn escape is 'flawed'

BOSTON — U.S. prosecutors on Tuesday said a former Green Beret and his son, wanted by Japan for helping former Nissan boss Carlos Ghosn flee the country, were advancing a "flawed" interpretation of Japanese law to fight their extradition. Michael Taylor and his son, Peter Taylor, were arrested in Massachusetts last month at Japan's request for allegedly smuggling Ghosn out of the country on Dec. 29, 2019, in a box while he was out on bail awaiting trial on financial charges. Ghosn fled to Lebanon, his childhood home, after being charged with engaging in financial wrongdoing, including by understating his compensation in Nissan's financial statements. He denies wrongdoing. Lawyers for the Taylors in a motion last week asked a federal judge in Boston to quash the provisional warrants issued in May for their arrests, arguing that "bail jumping" is not a crime in Japan. Defense lawyers argued that helping someone jump bail was also not a crime. While Japan issued arrest warrants for the Taylors in January, the lawyers said the crime stated in the warrants is an immigration offense and a non-extraditable misdemeanor. But U.S. prosecutors in a brief filed on Tuesday said it would be "unprecedented" for the extradition case at this junction to be tossed based on a "flawed interpretation of Japanese law and a mischaracterization of the facts." While Japan has not yet formally sought their extradition, the country has confirmed that Taylors' conduct constitutes a felony, U.S. prosecutors said. "The purported loophole through which the Taylors seek to evade justice simply does not exist," U.S. prosecutors wrote. Prosecutors added that neither Taylor, including Michael, a U.S. Army Special Forces veteran and private security specialist, should be released from jail as they are flight risks. Mitsubishi EVs manage 1-2 division win at Pikes Peak *UPDATE

*UPDATE: Monster's time has now officially been posted as 9:43.9. Looks like coming back for a third crack at the mountain was the right move for Mitsubishi. At the 2014 Pikes Peak International Hill Climb this past weekend, the two all-electric Mitsubishis, one piloted by Greg Tracy, the other by Hiroshi Masuoka came in first and second, respectively, in the Electric Vehicle division. The EVs were the third iteration of the MiEV Evolution prototype racer, which until now has had a tough time getting to the top of the podium. The first version crashed in 2012 and came in second and third – behind Nobuhiro "Monster" Tajima – last year. This year, Monster suffered a transponder glitch and his final time could only be estimated at 9:46 was 9:43.9. That's pretty much the same as last year, when he finished with a 9:46.530. Last year, the Mitsubishi duo finished with times of 10:21.866 (Masuoka) and 10:23.649 (Tracy), So, if Monster equaled his time from last year, then the Mistubishi drivers must have improved their times up the hill to beat him. They did more than that, though, dramatically lowering their times to 9:08.188 (Tracy) and 9:12.204 (Masuoka). What's most impressive is that Tracy's low time was just 2.4 seconds behind overall winner Romain Dumas, who drove a gasoline-powered Le Mans sports car prototype up the hill. Mitsubishi Motors posts surprise loss as car sales slide

TOKYO — Mitsubishi Motors on Friday posted a surprise operating loss in the third quarter, its worst quarterly performance in more than three years, hurt by falling sales in China, Japan and Southeast Asia, as well as a stronger yen. The carmaker posted an operating loss of 6.6 billion yen ($60.2 million) for the October-December quarter, widely missing an average forecast for a profit of 11.6 billion yen, based on analyst estimates compiled by Refinitiv. It was the firm's biggest loss since the July-September 2016 quarter, when a mileage cheating scandal sapped profits. However, Mitsubishi stuck to an earlier forecast for a 73% drop in full-year operating profit to 30 billion yen in the fiscal year ending in March. The automaker's net loss for the quarter just ended came in at 14.4 billion yen. The fall in quarterly sales was worst in China and at home, while sales also slipped in ASEAN countries, traditionally a stronghold, leading to a 16% fall in global vehicle sales to 320,000 units. The automaker also said it would keep some of its offices in China closed through Feb. 9, as a new coronavirus spreads throughout the country and beyond. The automaking alliance of Mitsubishi, Renault and Nissan on Thursday said they had "no other option" but to drastically improve their joint operations to remain competitive in the fast-changing global auto industry.
