$40M award for boy's death in Jeep fire upheld by Georgia high court

The Georgia Supreme Court on Thursday unanimously upheld a $40 million award to the family of a 4-year-old boy killed in 2012 when the 1999 Jeep Grand Cherokee in which he was riding was rear-ended and burst into flames. A lower court in 2015 reduced a jury verdict from nearly $150 million to $40 million. Fiat Chrysler spokesman Michael Palese said the company was "disappointed in this decision. We are considering our legal options." The Jeep's fuel tank was placed near the back of the vehicle, which plaintiffs said made it vulnerable to rear-end collisions. The Supreme Court ruling said "evidence showed that Chrysler had long known that mounting a gas tank behind the rear axle was dangerous. Evidence also showed that Chrysler's placement of the gas tank behind the rear axle was contrary to industry trends, which favored placing tanks in front of the rear axle." Fiat Chrysler lawyers said during the trial that the fire did not cause Walden's death and blamed the driver of the pickup truck that hit the vehicle. The company said Thursday it "continues to extend sympathies to the family of Remi Walden for their loss." On appeal, the company contended it was prejudicial to raise Fiat Chrysler Chief Executive Sergio Marchionne's compensation, which totaled more than $68 million, according to a company executive who testified at trial. The automaker had denied there was a safety issue and has said the vehicles were no more dangerous than comparable SUVs built at the time. The National Highway Traffic Safety Administration (NHTSA) linked more than 50 deaths to the Jeep fuel-tank issue. Under government pressure, Fiat Chrysler recalled 1.56 million 2002-07 Jeep Liberty and 1993-2004 Jeep Grand Cherokee SUVs in June 2013 to address fire risks and agreed to install trailer hitches to protect the gas tanks. The recall and a "customer satisfaction campaign" that covered the Jeep in the fatal Georgia crash occurred after Marchionne held private talks with senior U.S. Transportation Department officials in 2013. The Georgia Supreme Court opinion said the award was proper in part because Marchionne was "alleged to have specifically interjected himself in a federal safety investigation to the detriment" of the Walden family. In 2015, NHTSA announced Fiat Chrysler would pay a then-record $105 million civil penalty over lapses in safety recalls involving millions of vehicles, including older Jeep SUVs for fire risks. Dongfeng and PSA extend Chinese joint venture

BEIJING/PARIS — China's Dongfeng and Peugeot maker PSA are extending their business cooperation, despite the Chinese company reducing its stake in PSA to help smooth the French carmaker's merger with Fiat Chrysler Automobiles (FCA). Dongfeng said on Thursday it had agreed with PSA to extend the duration of their joint venture Dongfeng Peugeot Citroen Automobiles (DPCA). Under the deal, the venture could get the rights to PSA's new brands in China and will benefit from new technologies and intellectual properties, the Chinese company said. PSA was not immediately available for comment. The announcement comes a day after the companies said Dongfeng would reduce its 12.2% stake in PSA by selling 30.7 million shares to the French company. Analysts said the move could smooth U.S. regulatory approval for PSA's roughly $50 billion (GBP38.97 billion) merger with Italian-American carmaker FCA. The sale of Dongfeng's shares in PSA, worth around 680 million euros ($757 million), will leave the Chinese group holding around 4.5% of the merged PSA-FCA, which is set to become the world's fourth-biggest carmaker by sales volumes. "As the cooperation between Dongfeng and PSA deepens, we expect the joint venture to continue making good progress in China," a Dongfeng representative said. On a conference call, Dongfeng said DPCA would have exclusive rights to PSA's Opel cars should the partners agree to bring the brand to China, and enjoy lower prices on car parts imported from PSA. Earlier this year, a document seen by Reuters showed Dongfeng and PSA plan to cut jobs at Wuhan-based DPCA and reduce its number of car plants to try to make the venture more profitable. Mahindra fights FCA's Jeep infringement claims

The Indian manufacturer Mahindra is fighting tooth and nail to keep building its Roxor off-road vehicle to sell in the United States. In early August, Jeep mother company FCA filed a complaint with the U.S. International Trade Commission to stop Roxor sales in the U.S. FCA claims the Roxor design is an intellectual property infringement on Jeep design, meant to undercut FCA's own Jeep products on the market. Now Mahindra has released a statement to the commission saying that FCA's complaint is without merit. While FCA stated in its claim that the Roxor is "an imported low-quality knock-off kit car," Mahindra points out that the vehicle took several years to develop and is manufactured in Michigan. Mahindra intends the Roxor to be an off-road vehicle only, and says it does not compete with Jeeps. The Roxor isn't road legal, only comes with a diesel engine and reaches a top speed of only 45 mph. However, it has to be said that the uncomplicated Roxor is far closer to the original ethos of WWII-era Jeeps than the Jeeps FCA currently manufactures. Mahindra also states that FCA agreed in 2009 not to bring about infringement claims as long as Mahindra used a grille design that FCA approved — going with a grille design that clearly differs from the classic Jeep trademark grille. The matter might partially muddled by the fact that the grille agreement was made with 2009's Chrysler instead of today's FCA. Looking back several decades, the entire Mahindra Roxor appearance is at its core based on a 1940s license agreement made with Willys, the original Jeep manufacturer. Mahindra's statement addresses FCA as "Fiat," and it should not be forgotten that Fiat itself manufactured a Jeep lookalike, the Campagnola, from 1951 to 1973 — also with a different grille. Fiat Industrial subsidiary Iveco's history page says the 1951 Campagnola was constructed "according to the Willys mould". Mahindra claims that FCA is using the complaint to create negative publicity to damage Mahindra's reputation. The Indian manufacturer reminds us that it is the first automotive OEM to set up a new manufacturing operation in southeast Michigan in over 25 years — in Auburn Hills, not far from FCA's U.S. headquarters.
