Ram and Jeep diesel emissions allegations spur class action lawsuits

Last week, the EPA issued a notice of violation to FCA after it determined that Jeep and Ram installed eight undisclosed auxiliary emissions control devices on diesel vehicles. Since then US law firm Heninger Garrison Davis, LLC and Canadian firm Sotos LLP have launched class action suits on behalf of owners. These latest lawsuits are unrelated to a previous class action suit brought against FCA and Cummins over NOx emissions in 2007 to 2012 Ram models. The violation notice – and the subsequent lawsuits – covers 2014 to 2016 Jeep Grand Cherokee and Ram 1500 models equipped with the 3.0-liter turbodiesel V6, a total of about 104,000 vehicles in the US. The EPA says that while the emissions control devices aren't necessarily illegal, installing them without disclosing them to the EPA is, as they produce more emissions in real world use than in testing. Skirting certification in this way might be a violation of the Clean Air Act. FCA could see fines of up to $45,000 per vehicle, depending on the outcome of the EPA investigation. FCA denies that these are cheat devices, and has proposed software updates to bring the vehicles into compliance. As for the lawsuits, Heninger Garrison Davis says that "Fiat Chrysler marketed those vehicles as environmentally friendly with enhanced fuel efficiency, better performance, and lower emissions. Although the diesel vehicles were successfully marketed as 'clean,' their environmentally-friendly representations were deceptive to consumers." The suit seeks an undisclosed amount of compensation for owners of these vehicles. In Canada, Sotos LLP is seeking $250 million in damages on behalf of owners. This suit, filed in the Ontario Superior Court of Justice, also claims deception on the part of FCA, "resulting in losses and damage" to owners. These are similar claims to group actions against Volkswagen with regard to its diesel emissions cheating scandal. While VW is fixing or buying back many of the affected vehicles, the company is defending itself against some suits on behalf of owners, saying it expects " no decline in the residual values of the affected vehicles as a result of this issue." Don't be surprised if FCA mounts a similar defense.
FCA and ZF issue recall on nine-speed automatic transmission
Tue, Aug 9 2016After years of complaints, German transmission manufacturer ZF is finally issuing a recall of its much maligned 9HP nine-speed automatic transmission. Although it has been criticized for a number of issues, ZF is issuing the recall to address the possibility of the transmission unexpectedly shifting into neutral. The issue covers 505,000 vehicles in the United States alone. This issue is related to an improper crimp on the transmission wiring harness. Rather than a physical fix, ZF is issuing a software update to remedy the problem. The company doesn't recommend dealers attempt to fix the crimp. Although the transmission can be found in a number of models by various manufacturers, currently only those from FCA are being recalled. This is the second recall in less than a year related to a ZF transmission shifting into neutral. FCA recently recalled more than a million vehicles worldwide because of a poorly designed shifter for ZF's 8HP eight-speed automatic. That issue may have resulted in the death of actor Anton Yelchin in June. Although there are no deaths related to this new recall, NHTSA reports that the issue has resulted in at least 10 injuries. Issues with the transmission have been known for years. A number of software updates have attempted to address various problems, making us wonder if there could be a fundamental hardware issue as the complaints span across a number of automakers. Vehicles equipped with the 9HP include 2014 and newer versions of the V6 Acura TLX, Chrysler 200, Fiat 500X, upper-level Honda Pilots, Jeep Cherokee and Renegade, Land Rover Discovery Sport and Range Rover Evoque, and Ram ProMaster City. 2017 Jeep Grand Cherokee Trailhawk Quick Spin
Thu, Sep 1 2016Jeep won't come out and say it, but the 2017 Grand Cherokee Trailhawk exists to bloody the nose of the Toyota 4Runner TRD Pro. America's off-road brand hasn't built a wheeling-specific version of its Grand Cherokee flagship in years, and the last GC Trailhawk was mostly stickers and tires. It was time for a true trail-spec Grand Cherokee again. We took a quick spin (two of them, actually) in the latest Trailhawk model, which joins Renegades and Cherokees with the same badge and off-road bent for 2017. Our time was limited, and so were our initial findings. After driving on and off pavement at Fiat Chrysler's proving grounds in Chelsea, Michigan, we can tell you that on the road, this Grand Cherokee has the same refined driving dynamics as any other. As for off-roading, the capability is still somewhat of an open question. Driving Notes The suspension and off-road system tuning are what really set the Trailhawk apart from other Grand Cherokees. Jeep tweaked the four-corner Quadra-Lift air suspension to improve articulation and suspension travel, while retaining the 10.8 inches of ground clearance of lesser Quadra-Lift Grand Cherokees. Paired with the standard Quadra-Drive II four-wheel-drive system, rear electronic limited-slip diff, and 20-inch Goodyear Adventure off-road tires, the Trailhawk is not short on capability (at least on paper). Unfortunately, paper is almost where this stops. The Trailhawks we drove were pre-production models with unfinished software calibrations. The throttle on the 3.6-liter V6 Trailhawk we took on the off-road course was super touchy and hard to modulate, regardless of which Selec-Terrain off-road mode was selected. Without a reliable throttle, we were bounding over obstacles instead of negotiating them patiently. This was back in June, and Jeep's PR reps assured us at the time that the engineers knew about the oversensitive throttle and have since confirmed that the issue has been fixed for production models, which are rolling off the line in Detroit now. We're planning to get into one of those vehicles as soon as one becomes available for a full review. Like the standard model, the Trailhawk's air suspension offers more comfort than the double-wishbone front and four-link rear suspension on the 4Runner.
