Court puts kibosh on apartheid lawsuit against Ford, Daimler

Ford and Daimler have scored a major victory in a long-running lawsuit filed in US federal court by unnamed South African nationals. The suit alleges that both manufacturers and their subsidiaries sold their vehicles to the South African military, despite knowing that they'd be involved in violently putting down anti-apartheid protesters.
According to Reuters, South African plaintiffs filed the case under the 223-year-old Alien Torts Statute, a law which allows foreign nationals to file charges in US courts for perceived breaches of what was originally international law, but now more closely relates to violations of human rights.
And while the case - which also involves computer manufacturer IBM - has been tied up in federal courts for years, a recent case from the Supreme Court struck down a similar suit against Royal Dutch Petroleum (Shell), arguing that the ATS doesn't apply to corporations or to conduct if it occurred outside the US. In short, the law applies to individuals, but not corporations like Ford or Daimler. A US appeals court ruled that the conditions apply in this case, potentially drawing this long-running saga to a close, as the defendants will now be allowed to request that the case be dismissed in district court.

Toyota, Ford not interested in FCA merger

Sergio Marchionne will preach the benefits of mergers to anyone who'll listen, but his calls for industry consolidation may be falling on deaf ears. At least, that is, the ears of those who the Fiat Chrysler chief would most like to bend. Not only is General Motors uninterested, but according to The Detroit News, neither are Toyota or Ford. "It's something we would not be interested in," said Toyota's North American chief Jim Lentz, at the groundbreaking ceremony for the new Toyota Technical Center. "At 10 million (vehicles) we have enough scale right now to do what we need to do. There really would be no advantage for us." Toyota isn't the only one unenthused by the prospect of merging with Fiat Chrysler Automobiles. The Detroit News also reports that Ford, though it may yet to have been approached by Marchionne, wouldn't be interested either. "We're not a suitor for FCA," said Ford CFO Bob Shanks. "We don't see that type of opportunity as one that applies to us." With GM, Toyota, and Ford expressing disinterest in Marchionne's merger idea, the FCA chief will likely start looking elsewhere – or look for other ways to compel his primary candidate to reconsider. He may eventually find a partner – more likely in the Far East or within Europe – but it may not take the form of the major player Sergio has hoped for. Man has surgery to remove T-Bird turn signal that's been in his arm for 51 years

In 1963, real estate agent Arthur Lampitt was driving a new Ford Thunderbird near East Peoria, Illinois on his way to an appointment when he collided head-on with a truck. A massive accident that was so bad that it was originally reported as a fatal crash, Lampitt suffered a broken hip and that became the focus of doctors' efforts. In fact, no one noticed the fact that the turn-signal stalk had been broken off the steering column and had lodged itself in Lampitt's arm. Fast-forward to around ten years ago, when Lampitt set off a courthouse metal detector because of a "slender object, about the size of a pencil" in his arm. Despite that unnerving discovery, the doctor who examined Lampitt said that since it didn't hurt, he needn't worry about it. This year, however, it did start hurting and the affected arm started to bulge. Lampitt decided to have the issue seen to, and suspected it might have something to do with his 1963 accident. When he looked through photos of the wreck taken by a friend, he noticed the turn-signal stalk of the Thunderbird missing and figured that was the culprit. After a 45-minute outpatient surgery, the surgeon verified it: a slim, slightly bent and corroded, seven-inch metal cylinder with a trumpeted end. The surgeon said a protective pocket had formed around it, which is why it could remain in Lampitt's arm so long, but it was still unusual - "We see all kinds of foreign objects like nails or pellets, but usually not this large." Lampitt, who is expected to make a full recovery, says he might make a keychain out of it, once he's done just holding it.
