Court puts kibosh on apartheid lawsuit against Ford, Daimler

Ford and Daimler have scored a major victory in a long-running lawsuit filed in US federal court by unnamed South African nationals. The suit alleges that both manufacturers and their subsidiaries sold their vehicles to the South African military, despite knowing that they'd be involved in violently putting down anti-apartheid protesters.
According to Reuters, South African plaintiffs filed the case under the 223-year-old Alien Torts Statute, a law which allows foreign nationals to file charges in US courts for perceived breaches of what was originally international law, but now more closely relates to violations of human rights.
And while the case - which also involves computer manufacturer IBM - has been tied up in federal courts for years, a recent case from the Supreme Court struck down a similar suit against Royal Dutch Petroleum (Shell), arguing that the ATS doesn't apply to corporations or to conduct if it occurred outside the US. In short, the law applies to individuals, but not corporations like Ford or Daimler. A US appeals court ruled that the conditions apply in this case, potentially drawing this long-running saga to a close, as the defendants will now be allowed to request that the case be dismissed in district court.

FBI Seizes Computers, Listening Devices From Ford Headquarters

FBI agents searched Ford Motor Company's headquarters in Dearborn, Michigan, this month as part of an investigation into possible corporate espionage. Eight devices, along with documents, computers and financial records, were among the items seized by federal agents on July 11, according to documents obtained by The Detroit News. The FBI searched Leach's home on June 20 and seized more than two dozen items in that search, Reuters reported. Former engineer Sharon Leach, a 17-year Ford veteran of company, was fired last month, according to The News, which first reported the story. She admitted to placing recording devices under conference tables before meetings. She told Ford security she used the recordings to assist in her meeting notes. She couldn't remove the devices after meetings without drawing attention to herself, leaving the devices to record other meetings. Leach has not been charged for any wrongdoing. Former federal prosecutor and Wayne State University law professor Peter Henning told The News that using a search warrant, rather than a subpoena, shows the FBI suspects more employees could be implicated. "If it's an economic espionage case or trade-secrets case, that rarely involves one individual," Henning told The Detroit News. "So the concern is if you send a subpoena and ask for recording devices, those things can be erased." Leach, Ford and the FBI declined to comment on the investigation. IIHS crash tests second F-150 bodystyle

Sometimes, being the king comes with some extra scrutiny. At the urging of Automotive News, the Ford F-150 is the first truck to have multiple cab configurations crash tested by the Insurance Institute for Highway Safety. According to Automotive News, IIHS was preparing to release the crash-test report on the 2015 F-150 after the safety watchdog evaluated the popular, four-door SuperCrew body. However, the agency learned from AN that configuration contained steel bars welded around the front wheels for added protection. Those reinforcements aren't on the other cab variants, and IIHS is now going back to check a SuperCab without the strengthening to check its safety performance, as well. While the added bars might help the SuperCrew score better in the vital but difficult small-overlap front crash test, there's no guarantee that's their sole purpose. As the head of the IIHS crash lab Joe Nolan indicated to Automotive News, if Ford were just trying to beat the system the company could only put the reinforcement on the driver's side where the agency does the small-overlap test. Also, when the National Highway Travel Safety Administration checked the latest F-150, the Feds gave all three cab styles top, five-star overall ratings. Due to the additional testing, IIHS won't have the F-150's scores ready until July, according to Automotive News.
