Ford faces class-action lawsuit for selling vehicles without brake override systems

A total of 20 Ford customers are suing the automaker in a class-action lawsuit for selling vehicles "vulnerable to unintended acceleration." According to Reuters, the suit names 30 models built between 2002 and 2010 with electronic throttle control systems but without a brake override system. Those include the 2004-2012 F-Series pickups and the 2005-2009 Lincoln Town Car. Adam Levitt, a partner with the law firm of Grant & Eisenhofer says the plaintiffs in the case want "to be compensated for their economic losses by having overpaid for cars that contained defects." Levitt contends that the plaintiffs would not have bought their vehicles or paid less for them had they known there was no brake override system in place.
Ford began installing brake override systems in its vehicles beginning in 2010. In response to the lawsuit, Ford has pointed to research by the National Highway Traffic Safety Administration that indicated that unintended acceleration is mostly caused by driver error, saying in a statement that, "NHTSA's work is far more scientific and trustworthy than work done by personal injury lawyers and their paid experts."
Belville et al v. Ford Motor Co. will be heard in US District Court in the Southern District of West Virginia.

More than 800,000 Fords recalled for faulty Takata airbags

The Basics: Ford is recalling about 816,000 Ford, Lincoln, and Mercury vehicles built in the US for faulty passenger-side Takata airbags. The affected vehicles were all built in North America, with 654,695 recalled vehicles in the US and 161,174 vehicles in Canada. A wide variety of cars, trucks, and SUVs are affected. This is a planned expansion of an earlier recall. 2005-09 and 2012 Ford Mustang 2005-06 Ford GT 2006-09 and 2012 Ford Fusion 2007-09 Ford Ranger 2007-09 Ford Edge 2006-09 and 2012 Lincoln Zephyr and Lincoln MKZ 2007-09 Lincoln MKX 2006-09 Mercury Milan The Problem: Like every other Takata recall, the problem rests with faulty airbags that can potentially expel shrapnel, injuring or killing vehicle occupants. Millions of vehicles from dozens of automakers are affected, so don't think that Ford is alone on this one. Injuries/Deaths: Ford stated in a press release that there have been no injuries or death linked to the vehicles in this recall. All in all, 11 deaths and 180 injuries across a variety of automakers have been linked to these Takata airbags. The fix: Ford will contact owners soon, and the affected vehicles will have their airbags replaced by a dealer at no additional charge. If you own one: Wait for contact from Ford, then head to the dealer to get a replacement. Dealers price gouging Ford Mustang 50th Anniversary Edition by up to $20k [UPDATE]

UPDATE: Sheehy Ford's Cory Belcher got back to us, confirming that the price premium was related to the limited nature of the 50th Anniversary Mustang and that the figure listed was based on what other dealers were charging, while adding that the dealership was "very flexible" on the final price of the special edition car. So while there remains a hefty markup, it's possible that consumers could get out the door without spending quite so much over MSRP. It's no secret that dealers take some – let's call them "liberties" – with the prices on vehicles that are very new, highly in demand or available in very limited numbers. As we've explained before, they're well within their rights to charge so-called market value adjustments. We don't usually see these adjustments on mainstream vehicles, though. Then again, you could argue that the 2015 Ford Mustang 50th Anniversary Edition is not necessarily a mainstream vehicle. It starts at $46,170, which isn't peanuts, but it's still a Mustang. There's still a large portion of the buying public that could put one in their driveway, if they so chose. Then again, maybe they can't. That's because dealers are (still) issuing massive premiums on top of MSRP for the limited-edition model. It's happening at Sheehy Ford Gaithersburg, where a salesperson named Lou confirmed to Autoblog that the dealership is charging around $20,000 over MSRP on not one, but two Anniversary Editions. He explained that Sheehy isn't alone in the upcharge: "We like to see what other dealers are asking for," he told us, in reference to the limited edition 'Stang. We have a message in for the dealership's general manager for deeper info, too, and will update this post when/if we hear back. We corroborated Lou's story, though, with another Maryland area dealer, Century Ford, who confirmed that the $46,995 listed on the dealer's website for its Wimbledon White Anniversary car was incorrect, and the actual price was "around $64,000." He echoed Lou's reasoning for the upcharge, while adding that dealers are likely only going to see one or two examples, of the 1,964 produced. Perhaps the most worrying part of this entire affair is the sense of deceit that accompanies it. Neither of the dealers we spoke to copped to the market value adjustments on their website. We had to call and ask specifically about the cars in question to get the actual price.
