GM does not have to turn over its ignition switch documents
Fri, Nov 27 2015In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.
Safety group pans GM’s new Marketplace in-dash shopping
Wed, Dec 6 2017When it comes to our cars, is the Internet of Things a godsend? Or a hidden menace that will create more problems than it will solve? On the same day General Motors announced it will equip newer-model cars with its in-dash Marketplace e-commerce app, a prominent safety group was shooting it down. National Safety Council President Deborah Hersman tells Bloomberg the technology will only contribute to distracted driving and hurt efforts to stem the tide of rising auto fatalities, which grew 5.6 percent to more than 37,000 in the U.S. in 2016. The National Highway Traffic Safety Administration says distracted driving was responsible for 3,477 fatalities and 391,000 injuries in 2015, the most recent year for which it has data. "There's nothing about this that's safe," Hersman told Bloomberg. "If this is why they want WiFi in the car, we're going to see fatality numbers go up even higher than they are now." Marketplace, developed with IBM, will allow drivers — or more often, one hopes, their passengers — to order coffee or food, find gas stations and reserve hotel rooms from their dashboard screens. The technology is set to be uploaded automatically to nearly 1.9 million GM vehicles model-year 2017 and later that are equipped with WiFi hotspots and compatible systems. By the end of 2018, about 4 million Chevrolet, Buick, GMC and Cadillac vehicles will be equipped with Marketplace. The app will debut with a limited number of participating retailers, including TGI Fridays, Shell, Exxon Mobil and Starbucks, with more likely to join later. Online retail giant Amazon is also partnering with automakers such as Ford to bring e-commerce capabilities inside the car through its Alexa personal assistant. GM takes heat for aborted Silverado riff on 'Boston Strong' at World Series
Thu, 31 Oct 2013During game five of the World Series, Chevrolet was set to do a spot of marketing for the 2014 Silverado - fans at Busch Stadium in St. Louis would hold up placards that spelled out the words "Silverado Strong," a theme that Chevy has been promoting since the Silverado's launch with the song "Strong," by Will Hoge. The St. Louis promo was ultimately called off, though, over concerns that it'd be insensitive to the visiting Boston Red Sox. Now, the Busch Stadium stunt might not have been a big deal, had the St. Louis Cardinals not been playing the Boston Red Sox. Following the tragic events in Boston during the marathon back in April, the phrase "Boston Strong" gained traction among the city's citizens, especially at sporting events. So, you can imagine that Chevy's appropriation of the phrase might not sit well with some fans.
The stunt was ultimately shelved after images of the signs went viral before the game, leading to a bit of a public backlash. Chevy spokesperson Michael Albano said of the promo that it was meant to show the brand's "commitment to baseball and its fans." But after the images went viral, the company "realized there was the possibility that we may offend some of the very fans we were trying to honor," Albano told Automotive News via email.
