GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2022 Chevrolet Silverado and GMC Sierra now cost more, again

GM Authority put Chevrolet and GMC pickup truck prices under the microscope, spying the same macroscopic issues none of us can avoid seeing: Price increases. The 2022 Chevy Silverado 1500 and 2022 GMC Sierra 1500 have been hit with their third price increases this year. The Heavy Duty versions of those same trucks have been given their fourth price increases this year. Starting with the light-duty options, they've been rung up for another $900 across the board, which breaks down to $800 added to the MSRP and $100 added to the destination charge. The mandatory cost for shipping a truck from the factory to the dealer is now $1,795. That destination fee is now more than 5% of the purchase price of the least expensive 2022 Silverado, the Regular Cab Work Truck trim with a Standard Bed and 2.7-liter turbocharged four-cylinder retailing for $36,395 after destination. And that price is $3,200 more than the initial list price from last December. At the other end, the Silverado ZR2 is up $3,400. Average that out, and the Silverado's MSRP has gone up by nearly $700 every month since initial pricing came out. On the GMC side, the bidding starts at $37,195 for the Regular Cab Pro trim with a Standard Bed, a $4,700 increase over pricing announced last October.  Stepping up a tow rating or two, the Silverado HD is now $1,100 more expensive — $1,000 tacked onto the MSRP, the destination charge plumped another $100 to $1,795. The Silvy 2500 HD now starts at $41,295. The Sierra HD turns the screw a few more degrees, going up by $2,100 after the $100 increase for destination. The low bar for the Sierra 2500 HD is $41,995, a $4,100 rise over the price when it hit dealer lots last summer. Whew. Anyone know where the exit is for this "new normal?" Related video:

Kurt Busch to shake and bake (again) in Ricky Bobby car at Talladega

Kurt Busch will channel Ricky Bobby for another NASCAR race, this time driving a Wonder-sponsored Chevrolet SS, in this weekend's Camping World RV Sales 500 at the Talladega Motor Speedway. Unlike past tie-ins, though, there's actually an element of sponsorship here (the "Me" car was done when Busch was running on a team without sponsorship).
It was arranged by Flower Foods, the new owner of the Wonder brand. Wonder was part of the bankrupt Hostess company, which temporarily exited the US market 2012, and set off the Great Twinkie Shortage.
Busch has made something of a habit of channeling characters from famous racing movies, most recently running Tom Cruise's City Chevrolet livery from Days of Thunder in a Nationwide Series race earlier this year. Busch kicked off his movie-inspired antics, though, at Talladega in 2012, when he raced El Diablo's ("It's like... Spanish for like a fighting chicken") "Me" car complete with a cougar on the hood. He even went so far as to channel the lovable idiot that is Ricky Bobby during the race, dropping a few catchphrases about macchiatos and slingshots.
