GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Ford Police Interceptors dominate Michigan State Police testing

Once again, Ford Motor Company builds the fastest police vehicles. The Blue Oval touted the news in an official release following Michigan State Police and Los Angeles County Sheriff's Department testing. Ford did very well. Except for one acceleration metric – zero to 10 miles per hour – the Blue Oval's Taurus and Explorer-based cop cars were the quickest, with particular praise coming for the EcoBoost-powered models, which bested Chevrolet and Dodge's V8-powered variants. Dearborn's products also posted the fastest average times around MSP's vehicle dynamics course. But it wasn't all positive for Ford. The only four-cylinder in the contest, the 2.0-liter, EcoBoost Ford SSP Sedan, had both the lowest top speed, 120 mph, and the slowest acceleration figures. It was also the slowest in track testing. Ford's products also failed to match the braking and top speeds of its rivals from Detroit and Auburn Hills – the rear-drive Charger Pursuit posted the best braking stats of the entire test, while the V8-powered Chevrolet Caprice hit the highest top speed, at 155 mph. Ford did score a top speed award, among SUVs, but at 132 mph, the naturally aspirated Police Interceptor Utility had to share its award with the equally fast, rear-drive Chevrolet Tahoe. The LA County Sheriff's timing isn't publicly available, but according to Ford, the EcoBoost-powered police cars put on a similarly impressive show for cops on the West Coast. C7 Corvette turbo with 1,000 horsepower promised from Hennessey

If you can't wait for the next-generation Chevrolet Corvette ZR1, Hennessey says they will have you covered. The Texas-based company has announced it will offer a spate of upgrades for the 2014 Corvette ranging from a range of bolt-on options all the way up to a 1,000-horsepower, twin-turbo system. Buyers can start with a cold air intake, cat-back exhaust or stainless steel long-tube headers, but Hennessey says it will also offer up three stages of forced induction mayhem should those bits and baubles not provide enough thrust.
Those choices start with a supercharger system good for up to 700 hp, though Hennessey will gladly ditch the blower in favor of two turbos. Doing so will spin the crank to the tune of 800 horsepower all the way up to a certifiably ludicrous 1,000 ponies. There's no word on how much these tricks will cost you - or when they will be available, as we're guessing they haven't gotten their hands on the car yet - but you can head over to the Hennessey site to drop them a line if you're curious.
