GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. New 2016 Chevy Volt ad arrives in time for Tomorrowland

As summer approaches, so do the blockbusters. We've already seen Furious 7 and The Avengers: Age of Ultron, while Mad Max: Fury Road arrives this week. Next week's big debut is Disney's Tomorrowland, starring George Clooney, and not surprisingly, the advertising campaign is kicking into gear. Perhaps attempting to capitalize on the high-tech theme of the flick, Chevrolet has teamed up with Disney for the second-generation Volt's very first commercial appearance. As we reported previously, the Volt will star on the big screen when Tomorrowland hits theaters, and it will be accompanied by the EN-V Concept. Take a look at the Volt's Tomorrowland spot, up top. "Olympian" is one of the terms we use to signify the greatest height, the seat of the gods. Yet Mt. Olympus is the second-highest peak in the Balkans ranges, overshadowed by the crest at Musala in Bulgaria's Rila mountains. Both great heights, but one is a little higher. That's how we get the Olympian Chevy Camaro ZL1 pitched at the Musalic Dodge Challenger SRT Hellcat in Motor Trend's latest episode of Head 2 Head. The side-by-side spec sheet is filled with farcical numbers. For the ZL1, that's a 6.2-liter V8 with 580 horsepower, 556 pound-feet of torque, a 4,051-pound curb weight, 0-to-60 miles per hour in 3.9 seconds, a quarter-mile time of 12.2 seconds and a base price of just $57,800. Opposing that, the Hellcat wrings out its 6.2-liter V8 for 707 hp, 650 lb-ft of torque, weighs 4,449 pounds, does the quarter in 11.7 seconds and has a base price of just $60,990. Except in the case of the Hellcat, when Motor Trend put it on the dyno the machine spit out a reading of 672 hp and 606 lb-ft at the wheels. If there's a 10-percent driveline loss through those beefed-up internals and heavy-duty eight-speed transmission, that means the Hellcat is actually rated at about 750 horsepower and 700 lb-ft. But once they get put on a closed-off strip of coast road in Northern California, there are only a few strands of hair between their respective performances. That's not the case for they sensations provide; host Jonny Lieberman calls one of them, "One of the most incredible cars ever made," and says, "It changes everything."
