GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GM now finishing and shipping pickups it had parked for lack of chips

DETROIT — General Motors is more than halfway through shipping newly-assembled pickups that it had parked due to a shortage of semiconductor chips, a top executive at the No. 1 U.S. automaker said on Friday. "We've made great progress," Steve Carlisle, GM's North American chief executive said at the Reuters Events Automotive Summit. "We're a bit better than halfway through that at the moment and our goal would be to clear out our '21 model years by the end of the year. We'll have a bit of a tail of '22 model years into the new year but not for too long." The global chip shortage has forced automakers like GM to idle production or in some cases mostly build vehicles and then park them until the necessary chips can be installed, allowing those vehicles to be then shipped to dealers. Last month, GM Chief Financial Officer Paul Jacobson cautioned that GM's third-quarter wholesale deliveries could be down by 200,000 vehicles because of chip shortages. He did not break out what share of that was trucks. To expedite transportation of newly-built vehicles to dealers, Carlisle said GM bought a number of car haulers to deliver them from factories or distribution centers. The Detroit automaker has also allowed dealers to pick the vehicles up themselves in some locations. Carlisle said new vehicle inventories have shrunk to below 20 days in the United States due to the supply chain disruptions, but the company wants to get that back up to 30 to 45 days with some getting to 60 days depending on the product line. GM sees sales of gasoline-powered vehicles being steady over the decade and real growth opportunity in electric vehicles and software, with one not undermining the other, he said.  

Next-generation Chevrolet Colorado breaks cover in new spy photos

The next-generation Chevrolet Colorado broke cover in this fresh set of spy photos this week, giving us a glimpse of what to expect when GM's compact trucks are replaced in what is expected to be either 2023 or 2024.  Thanks to its still-extensive camouflage, this prototype doesn't give away a ton about the new Colorado's styling, but in profile, it appears as though the swoopy, upswept rear cab line might become a thing of the past. We wouldn't be surprised to see the new Colorado adopt a more angular, squared-off look more akin to that of its big brother, the half-ton Silverado. The Silverado is also expected to donate what may be the new Colorado's only powertrain. Taking a cue from Ford, Chevy is expected to offer the next-gen Colorado with just a turbocharged four-cylinder engine — the new corporate 2.7T in this instance. The large, 310-horsepower four-pot can easily take over for the 3.6L V6 currently available in the GM twins and one-up the 270-hp Ranger to boot. This would mark the end of both a V6 and diesel option being offered in GM's midsize trucks, and tracks with the company's slow, silent effort to eliminate lower-margin models. We say "trucks" because, well, whatever happens with Chevy is likely to translate to GMC. The Canyon will be due for replacement at the same time, and will likely carry on as a re-skin of Chevy's offering. We're not yet certain exactly when Chevrolet will start selling the next-gen Colorado, but given the reasonably complete state of this prototype, we expect it won't be long now.
